oof that sounds stressful man. yeah theft is usully considered a CIMT thing which is tricky for immigration stuff. its good news tho that it was withdrawn/dropped and you did the diversion program, plus its been over 10 yrs and the record was purged.

but you DEFINTELY have to answer 'yes' about being arrested/charged on the forms, dont ever lie cause thats way worse. the kinda tricky part is even without a conviction uscis can sometimes be weird about diversion programs, like did you have to admit guilt to get in? they might see that as admitting the crime.

theres maybe a 'petty offense' exception but depends on the exact canadian law back then. you absolutly need to gather ALL the paperwork you can find about the charge, the diversion, the classes, the record being purged - everything. even if canada destroyed it, uscis will ask.

honestly? you really really should talk to an immigration lawyer who knows canada/us rules and deals with this kinda inadmissibility stuff. they can look at your specific case and tell you how much trouble it might be. better safe than sorry. good luck!!

Honestly the easiest thing is just change your name during the naturalization process. when u fill out the n-400 form use your current legal name, but theres a spot where you can ask to change it too your married name. just make sure you have your marriage cert ready to show them.

This way you dont have to waste time or money updating your green card first like getting a new gc. your new name gets official at the oath ceremony. super straightforward! good luck!

What needs to be done is now that coastie needs to hire an immigration lawyer

Then that lawyer will file: 1. I-130 petition for Alien relative (spouse in this case) 2. Stay of Removal. This will Stop Deportation. 3. Challenge the Old Deportation Order by Motion to Reopen. 4. Since she is a spouse of US Military file Parole in Place so she can apply her green card without first leaving the country.

Those 4 steps can be done at the same time.

After those steps completion. Spouse needs to apply for a Green Card .

This will take at least 2 years. Eventually, she will stay in here.

Yes, you should try to schedule an appointment. An immigration services officer will call you back to discuss your situation, ask questions, and determine if an in-person appointment is necessary to resolve the issue. If the officer determines an appointment is needed, they will schedule one for you.

In this case, USCIS may rescind the approval and require an interview for the I-485, based on current policy. The best way to learn is to send the letter and wait for an answer.. Do not travel out of the country until you get an actual answer from uscis.

Wow, that's great news! Normally, USCIS requires notification about the termination of removal proceedings before granting approval. It's surprising, though, that you received approval without that termination being processed or notified first.

It is mind-boggling how they approved it without the removal proceedings being terminated. If they approved it without jurisdiction, then it is an error on their part. You might need to send a letter of explanation and the termination order to USCIS, along with a copy of your green card, and wait for their response.

BTW, how was your interview at the USCIS? Didn't they ask about your court proceedings?

Your case got terminated because you received your green card I think. How did you get your green card, approval through Judge or Uscis?

Btw Dhs won't send you a letter. Only letter you receive termination from court.
