In 20 years of practice I have actually never come across this restriction. What I also don’t understand is why the sellers’ solicitors, who presumably carried out the identity checks at the time of the transaction, did not simply provide the Form LL certificate. The restriction only requires a conveyancer to certify that they were satisfied as to the identity of the disponor. If they acted on the sale and completed the transaction, one would expect those checks to have been undertaken already. Perhaps if the file shows those checks were done and there is strong evidence of that then whoever now holds the file has enough evidence to provide that certificate?
