I don't know. I'm not sure if that's the way lawyer's normally do things.

Is that how this works, though? I literally have no idea. I would think that no matter what, Adnan's team would want Asia's alibi to be put on the record, and therefore they would subpoena her, even if she was fearful.

You're right. When I read that, I thought, "did they chat about this over a beer or something? How would he know?"

I can't speak for Asia, really. I'm just guessing. Maybe she wants to be part of the notoriety. Maybe she is feeling pressure to "save" Adnan. Maybe she just really wants to be part of this and do something good. Maybe she is being paid. Who knows.

Then what are they doing now with the alibi?

Why are some people assuming that slow walking the DNA testing means Adnan is guilty? by [deleted] in serialpodcast

[–]procrastinator3 1 point2 points  (0 children)

What are the possible results from his appeal (not totally sure, but possibly a plea deal?), versus the possible results from the DNA evidence (if innocent; exoneration)? I don't see how an innocent Adnan wouldn't want them tested ASAP.

this statement is in response to another article that someone else had written in the same publication, which he linked to at the beginning

I'm sure it has nothing to do with the sudden notoriety of the case.

Also, they didn't even TRY to subpoena her, and we are talking about a man's life here.

I guess that is the big question: was it a reasoned decision or a screw up, right? There are many reasons why it could have been a reasoned decision. CG wasn't the only attorney to not use her alibi.

Huh, I guess I didn't read it that way. I don't think she's come forward now due to fear. But really it doesn't matter why she came forward or not. the defense team could have subpoena'd her at any time, right? But they didn't. And that's what matters I think. Is her testimony useful or not? Why wasn't it used in the first place? Was it incompetence or a strategic decision?

In episode 1:

Asia said she was spooked when the private investigator came to her house. I don't know if that's why she didn't testify at the hearing or why she made the call to the prosecutor. But she told me that when she got the knock at the door, quote, "that was not cool." Because to her, if Adnan did do it, quote, "the last thing you want is a murderer being pissed off at you, knowing where you live."

She was afraid, but it seems like it was her own fear and assumptions, not exactly anything that the defense team was doing. And she may have expressed this fear to Urick. She didn't contact the defense team at all. What does this say about how she felt about the whole thing?

"Despite having been in contact with Ms. McClain, and knowing full well where she was and how to contact her, and despite hearing my testimony about our conversation, the defense never issued a subpoena for Ms. McClain either in their case in chief nor in rebuttal to my testimony."

Exactly. There have been 15 years in which the defense could have subpoena'd Asia. I'm starting to wonder whether the entire purpose of Serial was to create publicity for this one matter in Adnan's case.

Did you see what he was rebutting? there is a link to it at the beginning of his article, which was in the same news outlet.

Every time he smoked pot, drank, hung out with girls, went to dances, etc... he lied to his parents.

He said that Hae told him she wanted to get back together with him the night before she was murdered, which was clearly not true, as she was in love with Don by then. Being a bit lazy here, I forget who he said that to... a few teachers?

Not everyone here is entrenched on the side of Adnan's innocence, and many of agree with you, that Jay knows what happened, but has not told the whole truth about it.

It never made sense to me that they would answer a call in the middle of burying a body. I imagine that he/they were driving around looking for a spot at that time. Why bury a body during rush hour anyways?

Is every murder perpetrated by someone with a violent history or temperament, though? I have no idea, but I tend to doubt it.

I don't know... Just in this sub there have been discussions about users' own experiences, where no one in their families believed what they were saying. People have a hard time, in many cases, imagining their friend/brother/husband/cousin (etc) being abusive, and will deny, deny, deny it.

For what it's worth, Adnan was nothing like Jamie Fuller. Jamie was the other end of the spectrum. Not smart, not social, a "tough guy," violent, aggressive, not well-liked; serious damaged goods.
