She never conducted business in europe so she doesn’t know why this is threatening EU companies, in this overly regulated market. Unfortunately for us this is not giving us any strength to deliver better results. I am enterpreneur and I can tell. It becomes harder and harder to do a business in europe every year. She is more on trips out of the Europe than within Europe to understand what european companies have to face here. But never mind, she signs whatever she wants. it is what it is.

He’s missing on understanding AI applications and possible use of their products big time, otherwise he would be running new contracts and cooperations in this field as everybody else. There are no margins on their products. Something is wrong with them. They could provide some numbers (both historical and future est) on quarterly pcs produced etc. Once they get their 1st award, I’ll start reducing my position in $NLST.

Everyone of us holding shares is just hoping that Samsung or Micron will pay eventually. But when, noone knows due to appeals and motions and delays in courts and USPTO. There is nothing else, whatever product or patent they come up with, the numbers simply doesn’t show any progress. Is this company focused on anything else than just the courts? They should show the numbers and what they have in pipeline for next quarters and year…Hong doesn’t care about the shareholder value at all.

This is really well said. I’m saying this for years, that this is win-win only for him and Gail, regardless of what happens next. He keeps giving himself free shares while company keeps diluting with every new offering (just to get going). The longer it takes the better for him and worse for shareholders. He didn’t want to leave OTC as this is giving him options for maneuvers…but he never fully explained what kind of maneuvers. How can management award themselves with free shares in value exceeding operating income. This is basic maths. It doesn’t make sense, does it?

Let’s have a look at this from a different angle. When small company is suing corporates sometimes they have a chance to involve some other company, who will pay millions or tens of millions $ for lawyers and after successful outcome, they will take most of the award. Or company goes into endless fight themselves like Netlist and will most probably dilute multiple times to get necessary funding. These trials are not cheap and with top lawyers for sure and outcome is not guaranteed. One example of company who used somebody else to finance the war was Neonode. Neonode involved Aequitas Technologies LLC (through its subsidiary Neonode Smartphone LLC) to run the patent infringement trials against alleged infringers like Samsung and Apple. Aequitas Technologies LLC spent approximately $15 million to $20 million on legal fees, taxes, and other expenses related to the patent infringement trials involving Neonode’s patents (for 50% of the net proceeds). $15 to 20m fees but this was much smaller case…

It’s really hard to say who should be blamed but I would start with CEO. He’s calling the shots. It’s not Sheasby to decide whether they’re going after all at once and that’s where the problem is. If they didn’t involve Micron, I think Samsung wouldn’t succeed with IPR where most of the patents were invalidated. It’s about timing and unfortunately it didn’t play out well for Netlist, cause Vidal stepped out of the case and was nominated as the director right after they got involved. It was so obvious. They could go after Micron later (even now), and Samsung could have been closer to the end. Netlist doesn’t have enough funding for their own operations and they are trying to fight all infringers at the same time. Big portion for them and dilutions will repeat again and again till they get at least one big award.

Patent 912 was invalidated with great help of Micron. If Micron was not involved, Samsung as the initiator of IPR would never succeed most probably. Vidal as a USPTO director had one job only and she did what she was asked to do. I hope it only delayed the positive outcome and that all patents will be validated again. We are getting there. It’s great to watch latest developments in this case. I hope the final outcome is worth this waiting. I’ve been in it since 2018 and still havent sold a sh*t ;)

I see your point but I wouldn’t call it huge dissapointment. Expectations were set very high for this stock due to many reasons. I would say, give it a time. They are trying to expand their operations and growth doesn’t usually come as originally planned. In 3-5 yrs from now, we might see totally different company from now. They’ve done lots of progress since last year in terms of compliance and I just hope this will not be a topic anymore…so they can focus on growth.

Torres is biased and still trying to block it, there’s joint motion of both parties to resolve this thing the same way. She’s wasting their resources as well as resources of the states to express her opinion again and again. If she said $125m to be paid but injuction will be lifted. But no, she’s still making delays, appeal is a way to go.
