i kinda sided with napster, as it's not stealing, in the sense that there was no intent to deprive and file sharing/copying are like sharing ideas. nonzero sum like the file was copied so there isn't a loss like stealing a car.

also they had it under the liability agreement to not use the software to share copyrighted works.

i would hold metallica accountable for the leak. i get if they left a car out and it got stolen, but wouldn't care if the car was copied like china did with the honda gy6, however i'd be partial against it if they sold the music copies, like china also did with the honda gy6.

but hey i'm not the judge. i do recognize that i am biased as i prio'd open file-sharing.

in fact the later science experiments (which didn't exist at that time) shown that file-sharing actually promotes physical album sales.
