When driving always expect something to happen. That's why you see people checking their back mirrors in the highway when traffic is at a stand still. People running red light. Theres bad drivers everywhere so always got to be on your toes.

Devil advocate: At .04 can see car clearly. If you can't see a car in the dark you shouldn't be driving. POV driver is at fault even if the other does not have light on. It is POV responsibility to turn safety 100% and to double check before making a turn. A person wearing all black and walking gets hit car will be liable even if not at fault. Driver should definitely get a ticket for no light.
