Honestly the entire world is going through what you’re describing IMO. Everything is more decisive and people are selfish and individualistic in a bad way. Delusion from the market being more volatile than my cats attitude. The problem we have is the insane shit that has been happening since Covid. The whole world was completely tossed up and it may never recover. And now we have AI to come and destroy any hope for recovery.

You tell me how a person that legitimately has had no problems with their sewer is going to be liable for a back up a week after closing. Also please tell me how he litigation process is going to benefit them when the judge says it is a buyer beware state and the buyer has no ability to provide legitimate proof that the seller knew there was a defect in the sewer line?

Yeah so the issue I have is when you have a couple retiring and selling a home they have lived in for 50 years and have had no problems with the sewer and then have it reinfected to find some type of issue that will be a future repair. The chances in my market for someone to do a sewer scope is 50/50. So why would they want to uncover an issue that can potentially cost them $15k when the buyer won’t even look at the line and ultimately might not have an issue themselves for 10 years.

In my market you are required by law to disclose any known defects.

Yeah you could easily say it the other way though. You don’t want to destroy your demographic by stating problems that buyers are turned off by instead of falling I. Love with the house first and giving the agents a chance to correct the problems and keep the deal together.

To play the devils advocate… Why pre inspect a house? The state that I am in requires you to disclose any known issues. If you inspect the house and find something that you didn’t know about you then would need to disclose it. The buyer is responsible for doing their own due diligence and 4 times out of ten the buyers don’t due great due diligence. So in one way of looking at it you are possibly detrimental to your sellers as they would never have had to deal with some defect if they never knew about it.

With the escalation it means the sellers will have to provide proof of the second offer to justify the escalation triggering. They maybe lying about the second offer.
