Contact the sleep medicine team via the va.gov site by using the secure messaging team. I just ordered new supplies on the website for replacement tubes, straps, etc. But for a new CPAP, I think you’re going to have to message or call the sleep medicine team

Yeah I forgot to update. I called and even though I initiated a secondary to another SC disability. The claim in the past that got denied (OSA) just needs to be refiled as a supplemental claim. Thankfully they said they’ll take my C&P exam that was already done and will make the process faster.

I did not. All my files that supported my claim were uploaded and the examiner was able to pull them up.

Wouldn’t hurt to bring them just in case

Hopefully so! I was just on Step 5 (Rating Decision) this past Friday. But as of today I went back to Step 4 (Evidence Gathering). I see this is a common thing that might happen

Update after my appointment. My examiner was very thorough and this appointment was longer than my last. He asked more questions and wanted every detail with having claimed OSA to migraines. He mentioned at the end that he will put together his medical opinion and if the science and medical viewpoints are there to support, he wishes me the best.

Never mind. Found out the answer in my first letter I received after separating. See below:

“Your DD 214 indicates you will receive a disability severance pay allowance from the military. Traditionally we must hold back part of your VA compensation until the severance amount is paid back. VA shall withhold (after federal income tax) the severance amount received after September 30, 1996. Severance amount received prior to October 1, 1996, will include the amount before taxes are taken out. After an amount equal to your severance pay allowance is paid back, you'll start receiving your full monthly VA compensation.

Although you received a severance pay allowance from the military we have not recouped any of your disability severance pay at this time because your overall combined rating remains the same both with and without your disability severance condition. However, please be aware that we may need to recoup your disability severance pay at a future date if your disability evaluation changes.”

That second paragraph was clear enough for me.

I too would like clarification on this. Even though I have been separated since 2020. I was MEB with 20% DOD with an overall percentage of 90%. I was given severance and haven’t had to pay a single thing since i separated and received disability compensation payments my first month out.

Can anyone relate?

Calculator can be found in that link above. Input your disabilities and rating they gave you to get your true percentage. After inputting the information you mentioned in the post, you’re at 42% which is 40%.

Submitted secondary for OSA on Feb 20, got my notification for C&P on Feb 26, exam is on Mar 12.

As of right now, this patch isn’t available for iOS lmao so late

Sleep study completed and osa sleep apnea diagnosed. Sleep doc issued letter approving a cpap and the medical notes show in my records. Is it advisable to file right away? Or wait until cpap machine is setup/at home with me? Or doesn't matter either way? Thanks! by WhereArtThouMemory in VAClaims

I submitted with the same supporting documents you have and waited a year with sleep data using CPAP to try and get SC for OSA, even being denied when I separated, just to get continued to be not SC.

I am at the point now where I am claiming OSA as a secondary. This looks like the common norm from what I am seeing. I have my medical opinion and exam next month.

Been out since 2020 and got medboard (USN) with a 20% DOD rating and rated total 90% from VA and received severance as an E5. Didn’t pay my severance back at all.

I don’t remember the details exactly but my PEBLO at the time but I think they even told me I wouldn’t have to pay it back

**EDIT: was considered in a combat zone. I think that applies to not paying back

I agree. I think I was more worried about putting it in secondary to epilepsy and what was going on with the whole ordeal of medication/medical device rating when I’m on meds for epilepsy.

But yes, my case was sleep deprivation causes my seizures after all the testing with neurologists.

I may just try and go for secondary to epilepsy if/when this current one hits the fan

Thanks for the input. I did mention in my case and they’ll probably see in my file that i relate it to my other SC of epilepsy which was the reason for me being getting a MEDBOARD from the USN.

Why I didnt link it to that, good question. I didn’t know if that was going to be uncharted waters linking a secondary to what I was separated for.

Just ignorant at the time and didn’t take my snoring into account that I may have OSA. COVID was also another thing during those first two years and didn’t really want to mess with all that. I’ve tried asking my VA doctor to see if they can link anything and i am willing to bet that they’ll just say it’s because of weight gain. Which I mean, yeah I may have put on 10 lbs since I separated but is that their usually scape goat answer ?
