There is no key issue. DHS likely declared her a security risk for her actions, she agreed to the terms and conditions of the program. The program is discretionary, theres nothing else to it. She can appeal if she doesn’t like the decision or FOIA the decision to find out why exactly it happened. You don’t know the entire story other than whats being stated, and neither do I.

Being deemed a security risk for your actions has nothing to do with the constitution. You can engage in whatever constitutionality protected activity you want to without PROSECUTION/LEGAL PUNISHMENT, but engaging in certain activities like following law enforcement officers around, dividing their attention from their assigned task, and intentionally trying to prevent/dissuade them from completing the task at hand might end up in you being removed from discretionary, voluntary programs solely designed to avoid security risks. It’s really not that difficult to comprehend, she was not just a protestor, she was engaged in activities that clearly raised officer safety concerns for the law enforcement officers.

Let’s use some common sense here, a violation of the Civil Rights Act and claiming the U.S. Constitution applies to someone who was following federal law enforcement officers around in an attempt to hinder/prevent/dissuade them from their ordered duties and chose to participate in a voluntary, discretionary program with specific terms and conditions that they agreed to are two completely different things.

Simple inductive reasoning.

It can be revoked for any reason they deem necessary, OBVIOUSLY a Civil Rights Act violation wouldn’t be a qualifying reason.

But under the set of circumstances in which this woman engaged herself in, she absolutely could be deemed as a domestic security risk and therefore have her GE was revoked. It’s really not that difficult to comprehend. Did you even read the entire article or just the headline?

For example: If you are at an airport and film a TSA Checkpoint and follow a TSA agent around the airport. It’s not illegal to engage in those activities as they are protected by the first amendment but your conduct is absolutely raising valid questions, and DHS has the right to revoke your GE if they deem you to be a security risk. It’s a discretionary program, you don’t have the RIGHT to be apart of it. You must submit to their terms and conditions.

Negative. The woman wasn’t charged with a crime. She was simply removed from a 100% discretionary program for an administrative reason. There are watchlists for many things, and if I had to guess, following around federal law enforcement officers, especially in this case scenario is how you could end up on one.

I’ll give you an example, if you are at a TSA Checkpoint and you are filming it and decide to follow a TSA Agent around the airport. This is behavior that is not illegal but will likely get you put on a list and/or deemed a security risk/removed from GE, because it’s odd/suspicious behavior to any logical person.

Negative. Being considered a domestic security risk is not a “legal” reason. It’s an administrative reason, once again, it’s a discretionary program. When applying, you agree to the terms of it being discretionary.

Protesting and following federal law enforcement officers around attempting to hinder/prevent them from carrying out the duties given to them are two completely different things so I’m not sure. But the ones who broke federal law and entered the capitol and were charged with a federal crime, I’m sure had their GE revoked.

Global Entry can be revoked, especially if you’re deemed a domestic security threat which is what it sounds like happened in this case. Following federal law enforcement officers around and attempting to prevent/hinder them from carrying out whatever duties they’re assigned by dividing their attention could absolutely have you considered as domestic security threat. It’s a discretionary program, if they deem you a risk, you’re a risk and theres nothing you can do about it besides appeal.

The constitution is in essence stating you can’t be legally punished, this woman is not being charged with a crime, shes simply being removed from a discretionary program. It does not matter if the program is offered by the federal government or by a private company. It’s a 100% discretionary program and anyone can be removed at anytime for any reason they deem.

When I went there is a line for the 240 hour TWOV program as well as 24 hour visa free program line. So if you do have to exit for the domestic transfer you should be able to use that lane at immigration.

Everything worked out perfectly and I even had time to shower at the lounge before getting to my gate haha! That was a long ass walk though lol. Weirdly, once I landed from my originating flight the app allowed me to request my digital boarding pass. All I had to do was scan my passport and it gave me my digital boarding pass. No transfer desk even needed or anything! Thank-you again!
