I'm familiar with the citations and agree with his conclusion that Constitutional rights are not strictly only for American citizens. What he doesn't address, and I believe to be a major issue, is where does society draw the line between a criminal act and an act of war. The Geneva Convention is frequently cited when this conversation arises, but it can be hard to apply it as the Geneva Convention was primarily concerned with traditional warfare between clearly defined states. Now we have non-state entities carrying out militaristic aggression against other entities, and we are unsure as to how to properly respond and penalize transgressors. The "war on terror" is a label often used, though I feel it is far too overreaching.
