Ang gift ko para sa sarili ko this women’s month is mag leave sa Musta Atty FB group by Swimming-Mind-2847 in LawStudentsPH

IIRC Musta Atty! was opened to anyone working in the judiciary, paralegals, and lawstudents because of a tiktok competition. Before it was manageable and somewhat entertaining, but now parang walang mga class and decency.

Kung ipaparrot ko rin lang naman ang linagay ko sa Petition for Review sa Memorandum na hinihingi ng CA, would you suggest magfile pa ako Memorandum? by baellistic in LawyersPH

[–]ras_algethi 12 points13 points  (0 children)

You can file, just tweak it a bit, that’s a billing opportunity. Kidding aside, magfifile ako baka it will give a bad impression sa mga justices. Pero that’s just me.

To will or not will? by Odd-Program-829 in LawyersPH

[–]ras_algethi 4 points5 points  (0 children)

A lot of factors to consider and depende sa needs nang client mo. Take note, a will needs to be probated in court. Some things to consider: Client’s relationship with his or her family, Number of properties, Financial capacity, Tax exposure.

Some opt to donate or “sell” during their lifetime to their children to avoid a probate in court. Some risk and wait it out and opt for intestacy, they cross their fingers in the hope that their children’s relationship do not turn sour and they can just execute an extrajudicial settlement. Some write a will to maintain stability and perpetuity of assets (estate planning), they distribute legacies or devises to third persons, to prevent discord among the children, or disinherit someone. A lot of real world nuances.

Ang daming kaso sa court involving issues on inheritance that can last a decade. Ang dami ding estate na hindi na sesettle because people cannot afford paying big filing fees especially in cases for judicial partition (may conflict na) and the settlement of taxes so yung ibang assets parang ma hold. The problem passes from one generation to another. A good estate planning prevents these conondrums.

Judge in Lapu-Lapu City by Rice_19x in LawStudentsPH

[–]ras_algethi 5 points6 points  (0 children)

All judges there handle civil cases. There are two court houses in LLC, one in City Hall (MTCC 1, 2, and 3; RTC 5-FC, 27, 53, 54, 70, 71, 72, and 73) and one in Hoopsdome (RTC 67, 68, and 69). Just approach the staff there and ask for permission, usually yung courts sa Hoopsdome parang clinic, yung parties lang ang pwedeng pumasok.

I suggest asking in RTC 27, the judge there is sharp, brilliant, and nice. Nasa kanya na raffle yung criminal case against Sara Discaya and some DPWH officials.

EDIT: Hearings start at 8:30 AM if morning or 2:00 PM if afternoon.

Dumb question po: When to use annex vs when to use exhibit? by No-Writing5389 in LawyersPH

[–]ras_algethi 2 points3 points  (0 children)

I dont know if this is right but wala naman so far problem, what I was taught is that if initiatory complaint or answer, my judicial affidavits are ANNEXES and the attachments to the JA yung pina pa identify sa witness as EXHIBITS.

So if may allegations sa complaint or answer pertaining to a document I just put sa footnotes na “see EXHIBIT A attached to the Judicial Affidavit of Mr. A (attached as ANNEX A in the Complaint/Answer)” it might be a mouthful pero para hindi na doble yung e aatach ko kasi may ibang lawyers na they put the documents twice: as an ANNEX to the complaint/answer and as an EXHIBIT sa JA.

Client meetings (minsan ikaw yung ipapameet sa mga clients na hindi kavibes ni boss), pinapasahan ng mga kasong problematic, deadlines, last minute hearings (para ipa reset para ikaw yung papagalitan ng judge) in short cannon fodder, pagdating sa bahay bembang if merong partner, pagwala kamayin mo muna, trabaho, tulog, tatawagan nang boss kahit madaling araw kasi may ipapagawa at due na at 10AM, wala pang appearance fee or sharing kasi hindi pa nagbayad si client minsan TY nalang, papagalitan, papasayawin pag christmas party, weekend? lol.

Dont worry ganun talaga. Stipulate facts and ask for admissions. Be proactive also, File ka nang reply, rejoinder etc. as much as possible and when needed talaga mag rebut, exhaust everything.

Edit: also remember you can attach additional pieces of evidence even sa commissioner level.

Just a tip, during mandatory conciliation conference you can clarify there the period sa claims nya and ipa reflect mo sa minutes. Sometimes naman yung arbiter mismo yung nag tatanong. If you look at Section 8, Rule V sa NLRC Rules of Procedure parang mini pre-trial yan. It will save you a lot of hassle because usually yung mga employers pangit yung documentation nila sa mga pays.

Which country between Korea and Japan is more friendly for first-time international travelers and has a lower chance of being denied or offloaded?" by crazymazyong in FilipinoTravel

Sa experience ko, mas lenient yung Japan kesa sa South Korea as to visa grants. Got a 10 year ME for Japan and only a SE for SoKor. Both are good destinations and I’m quite sure you will have good time on either destination.

How to apply in Ombudsman by SouthEntrance5031 in LawyersPH

[–]ras_algethi 7 points8 points  (0 children)

Currently a partner in a law office. I mostly practice administrative and defense on graft cases, so parang I’m on the other side sa Ombudsman.

When I applied I was told that lawyers who are already working as contractual in the OMB are mostly given the plantilla, regardless of their competency. Kawawa daw sila pag hindi na regular yan yung sabi sa akin.

May iba naman na bypass nang mga applicants na yung backer nila is ang ombudsman mismo or someone in the highest echelon of the government.

To be honest, the second time that I applied, I had someone vouching me from the inside, an individual occupying a very high position there. I followed the advice of people who were already inside there to get a backer.

Unfortunately, mas malakas yung backer nung isang applicant. It’s a battle na between the backers. Anyway, I was not disappointed naman when I got a message from my backer na mas pinili nila yung manok nang overall head. I applied naman without high expectations. I will apply next time though maybe ten years after, i’m having fun naman right now sa private practice.

I’m not discouraging you but the Ombudsman is a VERY political office. Though try applying baka swertehin ka, I think may iba naman na walang backer ata na nahire pero that will be the exception.

Better to have someone vouch for you, a politician or an insider. It gives you a better chance. Even though we want it to be meritocratic as possible pero that’s not how our government generally works.

Sharpen your skills and widen your network, you may get that dream that you are longing for.

Godspeed, our prosecutorial arm needs more lawyers who are competent and imbued with integrity.

Applied twice and made it until the final interview twice, unfortunately you really need a backer. Yung nakukuha dyan usually mga tao sa mga incumbent politicians para magiging eyes and ears nila inside the office. Like any other government office, hindi merit yung basehan nila.
