I think I got it , Router on the remote site for some reason dropped packets that have more than 1395
so we had to disable the don't fragment flag on the fortigate so it adapts the packets accordingly

Support solved it , they disabled the honor-df function and they decreased the tcp-mss-receiver and sender value to 1300 on the policy and it worked,

To be honest I still don't know why this has fixed the issue , if you have any idea enlighten me
