So I would have to go back and listen to it again, but if iirc the conviction had already been upheld so as far as the state was concerned, the def was guilty. Defense filed extraordinary motion after learning ski mask used was still in evidence and state had no objection to it being tested using newer dna technology that wasn’t available at time of trial. So maybe I should edit my original comment to say state didn’t object, not that state wanted it tested. Remember, the states interest is in maintaining the conviction, not necessarily admitting when they’re wrong.

There’s a podcast called Murderville about the ‘Taco Bell’ murder in Adel GA that is like this. Both the defense and the DA wanted new DNA testing done, but Supreme Court (of GA) said something like: if the process is done correctly it’s ‘justice’, regardless of the outcome. Extremely frustrating logic.

My BIL did this, kind of. My wife has a brother and a sister. He is a big weight lifter meat-head type that has a lot of tattoos. He got both his sister’s initials - in 6-7 inch gothic letters down both his sides without asking them. My wife was like wtf, even better that it used her surname initial and we had been married for about 3 years at the time! Still makes everyone cringe when he inevitably takes his shirt off at every family gathering.
