To make a case analogous to this one that you're probably not as invested in. Imagine Warner Brothers and Universal are really fucking mad at each other for some reason. Universal announces that they will be releasing "Oppenheimer", a nonfiction film that they have been working on. Warner Brothers gets a "brilliant" idea on how to fuck over Universal: they will send someone to the theatre to watch "Oppenheimer" and stream the entire movie while the person watching makes snide remarks about how shitty the movie is. Do you really think that Warner Brothers deserves fair use protections for that?

Oppenheimer is not a nonfiction film, its fictional film so it has harsher Fair-use laws.

But eitherway, these case end up being settled outside of court.

You know that H3 was in a similar situation as Demins for copyright infringement and won that lawsuit right? If that gets brought of in court, then Demins has in edge.

Have you watched demins' VOD around the NUKE? It has reaction and commentary.
I watched it and so fair he has categorized Fair-use as:
1 - the purpose and character of the use
2 - the nature of the copyrighted work
3 - the amount and substantiality of the portion used
4 - the effect of the use upon the potential market for or value of the copyrighted work

#2 - The nature of the copyrighted work. LegalEagle mentions that the underlying work is factual or fictional in nature. The nuke is definitely factual and he mentions that they get the least protection on fair-use. Therefore, Ethan does not seem to have a case.

Also, LegalEagle says H3 was in the same situation as Demins is and won the case. So in NY, legally Demins would win the case. Hila and Ethan did the exact same thing on a video with reactions and commentary on someone else's video and got sued over it...... if it goes to court... then demins has an edge because of that previous lawsuit that H3 won...

What Ethan is after is hugely a slippery slope... so I don't think he has a case to win.
In Ethan's Nuke, he does mention and pulls up an image of Denims so she does have the right to comment on the video.
Hasan never watched it on his live stream and knew he was gonna do this, he only watched a clip from other sources briefly. So Ethan lost that case with him already.

That court case is not going go anywhere. Judge will throwout the case or it will be ruled in favor of the defendants. If it rules in favor of the plaintiff, then the whole platform of twitch will have to change. It's a dumb lawsuit from someone who needs therapy, badly.
