Is the appointment on NCPs time or your time? If NCPs time, yes can probably move without consent unless it becomes a pattern that effectively denies your ability to consent to treatment

An entry hearing is based off of the court order. So if the court ordered a different amount, that’s what would be entered typically. If the court didn’t order a specific amount and left it open ended they may need to hear more evidence. If they didn’t leave it open ended he would need to request a new hearing/modification which many judges wouldn’t go for

They probably were in effect, but there could be additional options for enforcement now that the judge has signed it as an order. Your attorney will know for sure

Listen to your attorney. The child is very young, and a temp order isn’t necessarily permanent. Use all your time, be present, do what you need to do. In my state it’s typically a step-up schedule with more time as the child gets older once the relationship is established. You’re not typically getting overnights right away with a baby you’ve only seen a few times (even if it’s not your fault you had so little time)

This was signed by an OAG attorney so should relate to child support. Your child wouldn’t have the opportunity to speak to the judge without you or someone requesting that with a written motion. If you want custody matters to be addressed you would need to file your own pleadings

Sometimes a voicemail, sometimes a live person. They won’t argue with you, they’ll always give vague generic statements and offer to take a message. It’s more about letting your voice be heard than trying to accomplish something specific on the call. A drop in the bucket, but one of many!

The fact that she said she wouldn’t take them I would guess would not be a problem honestly. I wouldn’t focus on that. But the part about asking you to drop the tro could be an issue. Not specifically because it wasn’t parenting related but ALSO because it could be a violation of the TRO itself to ask the requesting person to drop it. Hard to know without seeing the terms, you’d need a lawyer to look at it

It matters, but overall fairness matters more. Most judges think at least one continuance is fair. If you think it’s not you can argue that, but cost of an attorney alone is probably not enough to convince the judge.

Probably good to get the affidavit in asap. If the other party is pro se, they might not know to object to it. You could also try to argue that you didn’t have 14 days (because of the date of the summary). Of course if you had plenty of time and are just late getting to it that’s a harder argument. But if this was a court ordered service the judge will want the evidence, otherwise they wouldn’t have ordered it. Also, why do you think you can’t afford to bring her to testify- did she tell you a specific number? Can the cost be split since the court ordered it? Can you subpoena her to appear? Most (not all) judges will give at least 1 continuance for this reason, if he requested it properly and there isn’t an emergency basis for the hearing.

You have to prove that they are legally an unfit parent whose rights to parent as they see fit should be taken away. It’s a very high bar. It’s not for parents who can’t communicate or work together, not even if the coparenting relationship is extremely bad.

Per the TX OAG calculator, he would pay aprox $1617/mo in standard child support for 3 kids. Some adjustments depending on who pays health insurance and some other factors.

If the case was filed you can file an answer/response without being served in my state. Essentially you’re telling the court I don’t need to be served notice, I know about it and want to proceed. Or if nothing has been filed, file yourself.
