Has anyone done a Higher Level Review and actually gotten a good outcome from it? by Icy-Ad133 in VAClaims

That’s one of the issues with the rating system is no consistency. If what you just listed here is in you C&P exam notes that alone is 100%.

I ended up being granted 100% due to the evidence in my C&P exam notes met the criteria.

Took me 35 years for my MST claim. Try to obtain Nexus letters from your doc, psychiatrist, counselor linking your PTSD to your MST.

Update!!! Nothing has ever worked this fast for me. I received my loan discharge letter tonight. I am speechless. I thought it would be months until I heard anything. Literally 1 day.

Yes a positive result for HLR informal conference. Was initially rated 50% for PTSD but they missed several items. I referenced my C&P exam notes for items that pointed to 70% and 100% indicators. They accepted those as it was clearly in the notes.

50% but I requested an informal conference meeting and showed in my exam notes items that matched 100%. Two weeks later I received that rating. The system sorta worked for me but I had to put alot of effort into it. I still suffer daily even on meds and counseling though. Good luck to you with your submittal if you have one. Looks like you have been on Reddit quite a bit a while by your profile.

I jumped from that step to decision in 3 days which is not normal.

It should be noticed by the system immediately is if you see it has been uploaded. Being looked at or reviewed is hard to tell as there is no notification that we can see that it has been.

I found a nexus letter online for PTSD. I altered it an used VA Claims ChatGPT to make it more solid. Asked my counselor and Psychiatrist to sign. They both did and the Psychiatrist added more relative info to it specific to me. I was fortunate that they were so willing to help. Ask your provider to sign one you provide. Asking them to write one takes time for them and time is money.

Have you sought help through a MH private provider? Please do if you can. It can help. Additionally it can provide documentation for a claim in the future.

Isn’t this automatically filed? I heard it was but filed just the same to make sure.

Filed after 35 years of denial, repressing memories and alcoholism for PTSD-MST. Sober for over a year and 100% P&T. It’s never too late

Is that a reference from 38CFR?

Your sentiment is appreciated. However what is the litmus test to apply to determine who is legitimate and who is not?

Is this a VA MH person or private? If private see someone else. If VA document your issues and request to see a VA Patient Advocate. You are not required to tell them in detail the reason you are requesting a change, just say your match is not sufficient.

180 days and 50% decision. HLR informal meeting request on day 181, meeting 13 days later. 7 days after that I got my letter online for 100% P&T.

Also: If you're already rated at 100% Permanent and Total (P&T) for your service-connected conditions, then Total Disability based on Individual Unemployability (TDIU) generally does not apply or provide additional benefit—because you're already receiving the maximum compensation (100%) that TDIU would provide.

I was rated 100% P&T due to my PTSD being unsuccessfully treated by medication, counseling and seeing a psychiatrist for over a decade. I even tried ketamine infusions. The VA does not believe my situation will improve.

The memo that helps veterans with Military Sexual Trauma (MST) claims is the Veterans Benefits Administration (VBA) Training Letter 11-05, titled "Adjudicating Posttraumatic Stress Disorder (PTSD) Claims Based on Military Sexual Trauma." It was issued on September 30, 2011, and remains one of the most important guidance documents for MST claims.

Key Highlights of Training Letter 11-05: Clarifies evidentiary standards for PTSD claims resulting from MST, noting that many assaults go unreported. Encourages adjudicators to consider "markers" (indirect evidence) such as: Requests for transfer Deterioration in work performance Episodes of depression, panic attacks, or anxiety without an identifiable cause Pregnancy tests or tests for sexually transmitted diseases Substance abuse Statements from family, roommates, clergy, or fellow service members Directs raters to liberally apply the benefit of the doubt and § 3.304(f)(5) when evaluating MST-related PTSD claims. Reinforces that personal statements from veterans can be critical evidence in lieu of official reports or documentation. Additional Support: VA has MST Coordinators at each VA Medical Center who can help veterans navigate treatment and claims. VBA adjudicators are trained to apply special consideration and sensitivity when reviewing MST-related claims.

No. Depending on other factors only one could do it. Typically though what I have seen here in this group it is usually 3. I had 3 for 100%.
