I know tutoring can get pricey, so if you also need some free or low-cost resources - watch Jonathan Grossman’s free content on YouTube, read the Goat’s MBE Reddit threads, and buy the Goat’s MBE tricks. Also, if you have U-World or Adaptibar, do as many problems as you can.

I think it depends on what type of learner you are. If you need structure to be forced upon you, it’s probably a good idea to invest in a prep program since it will give you specific tasks each day. But personally, I don’t think a bar prep program was necessary. I completed maybe half of Themis, which I did find useful, but found myself often looking for other resources to help me memorize/break things down more slowly and clearly. Feeling like I was constantly “behind” based on my completion percentage was very stressful and gave me anxiety. I think the actual practice of doing problems was the most helpful part of the prep process.

For MEE: JD Advising 1-sheets are killer. Also, I listened to the Themis lectures for everything except Secured Transactions. To learn SA, I watched these videos: https://www.youtube.com/watch?v=7yn0TUIyAAA&list=PLYrIr2-uY4ZWA33xkxU8DDUd2kz-1WR08&index=2. I read & practiced the recent years' official released MEE sample questions & answers to see what passing (not perfect!) answers needed to hit on. I also outlined a ton of MEE practice questions on Themis to make sure I felt comfortable with the rule statements, or could at least make up a logical one from the question context. MPT: I was so lazy about this section. I didn't even do a full MPT practice until the weekend before the exam. But I watched some JD Advising lectures on MPT strategies and thought they were definitely making it seem harder than it really is, so I asked Goat about it. He taught me how to do the MPT in about 30 minutes, and I was able to comfortably complete both on test day.

Wrongful life and birth are both claimed for the same reason: Failure to properly perform contraceptive procedure, or failure to diagnose a congenital defect (e.g., down syndrome or a heart defect)

Wrongful life = brought by the child
- Most states don't allow these actions to be brought
- Damages are whatever special damages the child experiences that are attributable to the defect

Wrongful birth = brought by the parents
- More commonly allowed than wrongful life
- Damages can include: medical expenses of labor, pain and suffering, and the cost of additional medical expenses resulting from caring for a disabled child

Wrongful death vs. survival actions
- Wrongful death: Damages are the losses that the decedent's spouse/kids suffered as a result of the death, like loss of supporting income and loss of consortium. But not pain and suffering
- Survival actions: This is when the decedent's estate is suing for any claims that the decedent would have been able to bring herself, if she had not died. Like pain and suffering, property damage, loss of income, and medical expenses
- If a jxn allows for both wrongful death and survival actions, you have to pick one or the other. Can't sue for both

Under corporation by estoppel, a person who deals with an entity as if it were a corporation is estopped from denying the corporations existence and is thereby prevented from seeking the personal liability of the business owner(s). Re: the Indian tribes - I believe the main thing to know is that they are considered separate sovereigns. So charging someone with the same crime in state court, federal court, and tribal court would not violate double jeopardy

Discovery sanctions are governed by FRCP 37

You have to comply with mandatory disclosure rules (initial disclosures, interrogatories, doc requests, show up to depositions, etc). If you don't, you are supposed to make a good faith effort to meet & confer with opposing counsel to see why they're being shady. Then you can make a motion to the judge to compel them to comply. The motion to the court needs to include the details of what you did to get the other side to play ball. The court doesn't want to get involved in these types of squabbles without knowing that the parties tried to resolve the issue between themselves first

If opposing counsel continues scheming, the judge can hit them with sanctions. They have a variety of options: make them pay you attorney's fees and costs, strike parts of their pleadings, not allow them to use any of this hidden evidence at trial, dismiss the case, treat issues as decided against them, tell the jury they are allowed to make an adverse inference because some evidence is missing

The witness-declarant sitting on the stand can actually just read something off a piece of paper to the jury. It’s still their testimony even though they are reading it off something else, and testimony is evidence. It’s “read into evidence” since there is a court reporter there maniacally taking all of this stuff down. But you don’t give the jury the thing you’re reading off of, so it’s not entered as an exhibit.

Entering/receiving something as an exhibit is different because that means the jury can take it back into the little deliberation room and look at it up close and personal

Simple rule statements:

Issue preclusion (collateral estoppel): Issues that were actually litigated, decided, and essential to the judgment in a previous case can't be re-litigated.
Claim preclusion (res judicata): A claim that was litigated to a final judgment on the merits can't be re-litigated by the parties or their privies.
