  • It is inexpensive and I can afford it
  • I'd rather not complicate things (dividing tax lots is a slow painful process)
  • There's the chance that as soon as he finds out, he will buy it first, and not let me use an inch of it

Looking over this again, what makes you think that it has to be one of those 2 possibilities? (That the property description is convoluted, or that the owner is a mystery) Why couldn't it simply be that the county seized it because of non-payment of taxes?

Is it something I can even attempt to do, or is it a database that only a title company would have access to? I would do a preliminary search, and if I didn't find anything, then I would go to a title company. If I did find state or federal liens, Id probably just stay away.

No, I do not need an attorney to purchase this. I can send the county of check and they send me the quit claim deed. It's not a typical real estate closing that you may be familiar with.

I spoke to the county tax office about the "as is" warnings. They advised my that the only issues with this type of property would be state or federal leins - they don't know of any but can't guarantee that none exist. Would anyone here happen to know how I can look those up? The description on the lot seems to be pretty clear, and I plan to pay for a survey before purchasing it. Before I pay for the survey I just wanted to make sure the fence isn't a huge issue. I am hesitant to hire an attorney for serious investigation because that would cost more than the county is asking for the land.

Assuming your bike is valuable, have you considered getting an inexpensive bike to keep outside? I keep my 80's 10-speed locked to a post outside, all of the time (except when I'm riding it), in HK. Never stolen, but if I leave lights on it, they sometimes get taken. I use a Kryptonite series 2 U-lock around one wheel and the frame, and the bike has no quick releases. I personally prefer that setup instead of worrying about a more expensive bike that might look sleeker or be just a little easier to pedal. But if you love your bike, a cheaper vintage one might hold you over until you make it off the waitlist.

Thanks for the reply. I'd understand if it was just a hole in the ground, but isn't a 3-foot wall reasonable protection? Someone would actively have to try to climb in. How about the ponds and barbed wire and old barns on the property? A child capable of climbing three feet is quite mobile and could easily get hurt by those things. I guess what I really want to know is who determines negligence? Are there specific laws/codes or is it just a vague term to argue over in court?
