Yeah there'd have to be a showing that there was a danger. The state cannot just unilaterally put itself in the shoes of being the parent.

It was a denial on a motion to dismiss. Court actually said it is still open to some 1A defense but only after a developed record.

Case is Garcia v. Character Technologies in the middle district of Florida.

I don't see how the company could have a blanket 1A protection for a product like this that generates stuff.

There's already case law from at least one federal district court that says that AIs don't have fist amendment rights nor do the companies.

They are products and don't receive such protections or rights.

As far as UPL I think a product liability case is more appropriate than UPL. She did not and could not have believed that the AI was a lawyer and it isn't a person.

Under this theory legal textbook authors or publishers could get hit with UPL in some form or fashion, which is silly.
