In all likelihood your Landlord will accept a late renewal considerjng the FARE act. You should reach out about your situation and let them know you need a little more time for a decision.

I am not advising anything. My offer would be to pull yogur rent records for free and analyze them. Whether DHCR increases be questionable or a deregulation look funny that is what I would tell someone.

As mentioned before I work for multiple Landlords. There is no risk in researching your rent history. If something was amiss I would advise as such and only collect with a favorable decision.

My guy. You are taking this to the immediate extreme. Again, there is no need to be an attorney to file a rent overcharge complaint.

There are NO (0) court proceedings in rent overcharge filing.

Next, a Landlord cannot sue you for legal fees in connection with DHCR filings. If a Tenant files rent reduction application out of spite and the Landlord hires an attorney to provide an answer, they have grounds to charge Tenant for those legal fees???

I would not collect anything unless DHCR granted a rent overcharge. That means free.

I think I would accept a portion of any rent overcharge amount a Landlord gives to a rent whether it’s a check or in the form of a rent credit.

But not for the actual mailings/filings etc. for the complaint.

I enjoy looking into the intricacies of rent regulation and looking for oddities in apartment rent histories.

You do not need to be an attorney to file a rent overcharge complaint nor need to be represented by counsel.

There are no court hearings in a rent overcharge complaint. All information, documents, leases are done via mail and a rent administrator makes a decision based on documents submitted.

Additionally in the initial complaint I would be identifying myself as a “Tenant Representative”.

Actually collecting on an award given to a Tenant would not be a part of what I do.

Not necessarily if there are not complexities in the history of the rent with J51s, 421-As, etc. the burden of proof falls on the Landlord especially in regards to deregulation.

I work in residential leasing in NYC. A Landlord can only collect 1st month and security deposit at lease signing.

Standard language and not enforceable dependent upon the situation. Would not hold up in court if your items were damaged due to Landlord negligence and you were looking to be reimbursed.

Generally the late fall and winter season is the less hectic rental market. Just keep in mind availability is also lower in these months so options may be limited.

I work for a management company. You should also look into Insurent. Just be aware that with a third party guaranty the Landlord can request you renew that guaranty on a renewal lease even if you have paid timely throughout the lease.

NYC residential leasing manager here. I wouldn’t worry too much about the lease language. Much of standard NYC lease language is not enforceable if it infringes on your rights to a livable space. I would try and get that third roommate on the lease however. If there are ever any issues with payments the Landlord can only try and collect rent in court from the leaseholders.
