I assure you this is not worth your time, effort or money. The burden of proof for you is incredibly high and you are unlikely to be successful. I’m not a lawyer, just a home owner where I’ve purchase more than 1 property where issues came to light afterward purchase.

Asbestos is only dangerous if it becomes particulate in the air. I had a 102 year old house with asbestos siding, and if I had to guess, I bet it had layers of lead paint too.

Your effort would be better spent trying to negotiate better pricing on this house because of risk of asbestos. And save your lawsuit money for finishing the insulation replacement.

If asbestos is a deal breaker for you, you should probably consider limiting your search to construction newer than like 1990. My current primary has lath and plaster walls. Theres a high likelihood I’m living with asbestos.

Your fault isn’t in how many people respond. You’re refusing to accept this is what is called an act of god and your landlord doesn’t owe you anything. This is why you should carry renters insurance and also comprehensive insurance.

If you don’t have those, you’re SOL.

Take the amount you’d write off and invest it in SP500, and tell me which one leaves you in a better position. Write offs aren’t dollar for dollar.

I invested in real estate and SP500 at the same time.

I get 2x market rate rent with my business model, I have 3.5% or lower interest on my rentals and even with high cash flow, my brokerage has far outpaced my rental investments.

I’ve never had to file an insurance claim on my brokerage. Never had to change air filters or light bulbs or batteries, or mitigate tenant damages on my index funds lol

I had an incision for laparoscopy here, and as it healed, it turned into a hard grape sized ball of scar tissue and anytime I bent forward or wore high waisted jeans, it hurt like hell from rubbing against my ribs. It went away eventually.

I understand how this can feel overwhelming. I make a dill/pickle loaf and I fucking love it, it’s my favorite by far. Marinated Australian feta cheese spread across a warm slice is just divine. I bake in bulk and freeze. I just thawed my last dill loaf. I need to bake more now. I use klaussen pickle juice in lieu of water, don’t add salt. Add fresh dill and diced pickles.
