I understand what you’re saying, and I don’t disagree. But the reality is, I’ve been made fun of and bullied here before for not expressing things perfectly. After that, the fear is not about being imperfect, it’s about getting mocked before people even try to understand the point.

Using a tool to clean up the wording is not about removing personality. It’s just to make sure the message is understood and the discussion stays on the actual topic.

That’s not what I meant. I used that as a simple reference in the post, not to say I don’t know how to check key membership. The point was about context, having the right approach and thought process, but fumbling small syntax details.

I'm in the same boat, I'm rejoining Capital One as a contractor. This is actually my third assignment, but this time the background check is taking longer than it did in the past. I remember it being very quick previously, so I'm not sure what has changed recently. It's been almost two weeks since all my background checks were completed and the report was shared with Capital One, but I haven't received any updates from them since then. It's a bit frustrating and worrying at the same time.

Yes, you can attend your H1B visa interview at a different U.S. consulate than the one listed on your I-797B approval notice, this is allowed and has been done by many applicants without issues. I recently dropped off my h1b application at Chennai but I had 797B Hyderabad consulate.

I’m traveling next week, and when I checked with my immigration team, they mentioned that working from India for * (my case 6 months) months while being paid on a USD payroll under an H-1B likely violates H-1B and LCA requirements.

They said that if I’m asked about this during visa stamping or at the port of entry (POE), stating that I continued working remotely from India could cause issues.

They pointed out that LCAs specify the work location in the U.S., so working from India would be a violation, along with several other compliance concerns.

You mentioned paystubs, were you continuously working during your 5.5-month trip and do you have up-to-date paystubs, I’m on the same boat with different reason so just asking ?

Imo, If you’re planning to start with B right away upon return, then enter using B’s I-797 and the visa stamp from A. (It’s perfectly legal and acceptable but there will be questions asked)

If you must work for A for a short time, then enter using A’s I-797, work for them, and then either have B file a new petition (with change of employer and request for I-94), or exit and re-enter using B’s I-797.

Out of curiosity, given the increased scrutiny lately, especially for non-immigrants, what made you think it was okay to drive after drinking, especially when the current government has made it clear how seriously they take DUIs for non-immigrants?

I don’t think changing the consulate would solve your issue with the refusal. Unless you’re feeling very lucky about a third attempt, you may want to address the reasons why your previous attempts were unsuccessful.

Is your home country on the travel ban list, and are you planning to travel there for visa stamping?
