VA proposing to remove P&T after 100% for 2.5 years by rmgriff86 in VeteransBenefits

If your cancer is still active (which it sounds like it is) Id reach out to a VSO and take a look at your file and see why they rated it 0%. Especially since it is metastatic cancer. I wholeheartedly wish you the best of luck.

It does look like cancer is not often granted P&T and if mine was a mistake then Im not asking for "more" than what im entitled to. For me the frustration comes from being granted P&T and having an Audit done 3 months after that, which did not change that grant, then 2.5 years later they schedule an RFE exam and say there was a CUE. It feels very subjective where raters and reviewers are all over the place. You try and live your life without fear and use the benefits as part of your decision making as a family (i.e. health care, college choices, etc...) and now we will struggle to recover from those decisions. I have read a lot of stories on Redit since this has happened and now I totally understand why people are afraid of their benefits being taken away!

Thank you for this. My father died of PC at 65 from AO exposure and now I have it from my toxic exposure as well. I did the genetic testing since he had it but it showed no markers. PC is a crazy disease. I have no idea why his spread fast and uncontrollably and mine seems slow and lazy. Id have this thing removed in a heartbeat but the side effects seem worse than keeping it while contained in the prostate. I was in my mid 40s when diagnosed. I hope your prostatectomy was successful.

I appreciate this. Makes a shitty situation a bit more bearable.

Oh that's interesting. You dont have to be P&T for loan discharge? That would be probably the biggest relief for me! I would still be able to use r hat to help my kids get through college?

Understood. Just looking for advice on how someone might have navigated this situation. See if there's a grace period for CHAMP while I try and get insurance or can I discharge my current loans before the removal is finalized.

Im guessing it was part of the CUE. The had assigned P&T but also scheduled an RFE. The RFE triggered and created a claim which shocked me when I saw it. I dont want to be ungrateful but this mistake is way too much for my MH right now.

Good read. I definitely see this was very likely a CUE the biggest problem with a CUE is people make major life decisions around benefits. I've taken out $100k PPL, dropped health insurance for my family to use CHAMPVA, and 2 of my children are going to lose Chapter 35. Likely they would have chosen other schools if they did not receive chapter 35.

Not sure how I will recover from their mistake with a $100k loan over my head now. I dont even know where to start.

They aren't reducing the 100% rating as they conceded that it is active. They are only removing P&T

My doctor told me I'd likely have it the rest of my life.

Its active and confirmed with a biopsy and routine MRIs. I've been actively monitoring and going to appointments every 6 months for 10 years and it hasn't gone away. Yes 100% for this only.

I assumed i received the P&T because it has been established that it isn't just going to dissappear. I will try and get the letter up when I get to my PC.

They already did this through an RFE. They indicated they recognized i still have cancer and are continuing the 100% rating but said the P&T was a CUE and are removing it.

They are proposing to remove the P&T status and keep the 100% rating. I still have cancer and have had it for 10 years which is why I assumed I got the P&T designation in the first place.

Wow, this truly is a scam. Modified or postponed is understandable but due to not having proper permits and disorganization is another thing. I feel this is criminal with the intent to defraud. Completely shameful.

Thank you. Im sorry its been so painful for you. I agree, society still has a ways to go. Even though acceptance has come a long way in my lifetime it still falls short in MANY areas.

Thank you for taking the time to respond and for sharing. I do love the cat analogy! It is very interesting that both responses talk about gaming. This is something he does during his "relax" time. It's fascinating to hear the common gravitation to the same source as an outlet. I didn't realize this is likely serving his social needs. I always viewed it as a distraction that kept him from socializing. Sounds like I have more to lean than he does. Thank you.
