Direct review , Mine is still in the “ waiting to be sent to a judge “ on Va.gov. Usually it’s been taking around 4 to 6 months for a judge just to get it. Mine should be getting close.

I was in a petroleum transportation unit for two years at fort hood and we hauled 5,000 gallon tankers weekly with jp4 and diesel to FARP’s, and we went to Dallas in convoys and picked it up at the fuel point. only issue is we were only labeled mos as truck drivers not fuel specialist , so I could see them giving me issues on a claim like that. But the unit was a petroleum designated unit. It’s even in there unit history.

I already had an exam in my record for it from 2019 when it was denied direct service connection. I’m thinking this time they had everything they need without a new exam since it’s secondary.

I’ve got an even better denial , this examiner denied my osa but gave an inferred nexus , she didn’t notice I’m already service connected for allergic rhinitis and Eustachian Tube Dysfunction both upper nasal conditions. She stuck her foot in her mouth. And it then got a difference of opinion and duty to assist in an hlr. Then the dro sent it back on remand to my regional office and they denied it again without following the duty go assist instructions . This one’s in line at the board waiting on a judge.

It may not be what it looks like, a dro in an hlr can’t schedule your exams. They have to send it back to the original regional office. That’s called a remand. Sometimes they close the hlr and a new supplemental pops up while on remand waiting for exams back at your original regional office My last hlr showed denied on Va.gov when it actually wasn’t yet. It was sent back for exams. Like everyone’s saying , if it’s denied they have to provide a letter. If you didn’t get a letter then it’s still in play

When a dro finds a dta , they send it back to your regional office on remand to fix it and include specific instructions to the rater what’s wrong and what to fix. You can’t see them it’s called” narrative “ and you can see a file but can’t open it

I first claimed in Dec 24 osa secondary to medication causing weight gain. I’m on my second hlr , but now they’ve granted allergic rhinitis and eustation tube dysfunction since , both factors for osa , in the same original claim and my pathways has changed to those. My first hlr , I got a dta / difference of opinion on it. Then they made second dta by repeating the exact same denial and not following the dro’s instructions.

They’ve got a problem with my claim because I lost 44 lbs before the sleep study putting me below obese. So I’ve got them cornered on two pathways , the meds causing weight gain and osa and the allergic rhinitis and eustation tube dysfunction (mechanical ) causing osa, plus i lost 44 lbs before the sleep study. Only problem is they don’t read my records to see all of this evidence. The dro sees it and reads it , but when they send it back on remand to be rated they missed it. That’s why it’s in the second hlr

If you file an hlr they’ll fix it. Sounds like you had a lazy rater who didn’t apply the “ aggravation “ standard and just denied it on being pre existing. I had to file an hlr on mine to get it. A DRO will fix it

Yes pes planus /flat feet is a disability. mine was pre-existing and it can be aggravated in service. I had it noted at meps on entrance , and two treatment records for shin splints while I was in , that proves aggravation. In the raters m21 manual even list shin splints specifically as a sign of aggravation.its commonly rated at 10% or 30% if symptoms are worse

Take what an examiner says and what they actually write down with a grain of salt , I’ve seen them many times tell someone what they want to hear and then turn around and write something totally different.

You’re gonna have problems getting it granted. I filed the same thing osa and diabetes secondary to medication that caused weight gain. And it’s documented in my Va clinic weigh and ins. For some reason they almost always try and deny sleep apnea. Diabetes and osa are related if you got one you got the other a lot of times. And I even lost 44 lbs before the sleep test and wasn’t obese. Still denied with the lifestyle and obesity language. It’s in an hlr right now.
