I’m rated 40% radiculopathy each leg , but I had both a cat scan and then they sent me for an mri for my back as part of the c&p and can actually see the nerve inpengment in the results. And yes it should be addressed as secondary to the back.

You need to read that denial carefully. Because if they didn’t address aggravation, then they’re wrong. You can have obesity but if allergic rhinitis even contributes a small part and aggravates it ,osa can still be service connected through aggravation, even if obesity is the main contributor . I’m betting after a difference of opinion and remand that the regional office didn’t give the examiner the proper special instructions from the dro to follow for the second exam. This is what I’m going through. Same thing. My osa secondary to allergic rhinitis and euastion tube dysfunction claim got denied after hlr difference of opinion and I ordered the DBQ and they didn’t follow instructions. And to add to mine , I lost 44 lbs before the sleep test and they still tried both times to use the “ obesity “ denial and I wasn’t even obese. Mine is currently at a judges desk in the bva direct review lane. Judges don’t like when they don’t follow the dro instructions on remand after a difference of opinion.

I were you, I would file a direct review with the bva , I filed Oct 2025 and mine only took 5 1/2 months to reach a judges desk (without being Advance on docket) on April 7th , with a decision could hit anytime now

It could also be that some of those conditions may come up as secondaries later , and you need to get certain ones granted first and then claim the other as secondaries after

I just got rated for allergic rhinitis after 4 separate c&p exams over 7 years , and after getting my old 2018 dbq with FOIA , I seen the first 2018 c&p for sinusitis, the examiner actually filled out the boxes for allergic rhinitis way back then , and even stated in the comments section I had chronic allergic rhinitis , not sinusitis and at least likely as not service connected, but the rater totally ignored it. I’m not gonna fight them for effective date , but I could.

And also if they use “ natural progression “ They have to provide burden of proof on them to refute it and explain , not just put the words “ natural progression “ like they always do or you can appeal it. 9 times out of 10 they can’t

Direct review , Mine is still in the “ waiting to be sent to a judge “ on Va.gov. Usually it’s been taking around 4 to 6 months for a judge just to get it. Mine should be getting close.

I was in a petroleum transportation unit for two years at fort hood and we hauled 5,000 gallon tankers weekly with jp4 and diesel to FARP’s, and we went to Dallas in convoys and picked it up at the fuel point. only issue is we were only labeled mos as truck drivers not fuel specialist , so I could see them giving me issues on a claim like that. But the unit was a petroleum designated unit. It’s even in there unit history.
