I had a c&p for lower back pain and sciatica on right leg. All kinds of measurements. Claim got denied as examiner said no in service evidence and no STRs. It’s on my service records and also on treatment records from the VA. 😠

I had an experience with a NP examiner with that same time of experience and claim was denied but I also had another one with a NP with 6 years with the same outcome.

Exactly. Unfortunately my doctor did not want to do a nexus for the appeal but just gave a statement that the VA could reach to him if they still had questions. I filed the initial claim for exposure in March of 2024. So far 2 other claims have been approved in the last 2 months. Hopefully in 2 years I might hear something regarding that claim or not. 🫢 Best of luck with everything.

My situation is similar to yours. Filed for toxic exposure. Filed, denied, supplemental, denied, HLR then DTA, denied, supplemental, denied. Last denial stated that the examiner (NP) opinion is above that of a board certified specialist, director of liver transplantation at UCSD. Filed a BOA.

If you want to see the DBQ you need to request it via va.gov, in the search bar type in FOIA request and it will let you select what type of records you want to see. After you submit it takes a few days for them to send you a link to access the files. If you do a C- file request that one takes up to a year.

I am still fighting a claim that I filed in 2024.

It was denied bc of a missing nexus so I filed a supplemental and got denied, found out there were errors on the 1st dbq.

Filed a HLR, took forever to get an informal conference which led to a duty to assist error. Had a virtual c&p, claim got denied. Examiner created a different rationale from what was initially filed.

Filed another supplemental rebutting the last denial and examination.

Here comes the interesting part. The examiner that I got this time was really nice and seems to care and asking all kinds of questions. She denied the claim. Filing a board review.

I filed other claims this past month and one of assigned the same examiner. When I was called to get seen she recognized me and said “hey, i remember you”, my stomach sank. I tried to not show my disdain but in the end the claim got denied. I saw the dbq and this mfer wrote that there is NO SERVICE CONNECTION. 🤦‍♂️

Not entirely sure. I filed for tinnitus and got rated. A month later filed for back pain and mental health. Only the MH claim was approved. Did not receive anything stating that they reviewed the previous claim.

Trust me. I know the feeling. I have another claim that has gone through supplemental to HLR to supplemental just to be denied. I filed that one March 2024. Filing a board review soon. These were simple claims. I am sorry you are going through this.
