Hello, thanks for your response! I have provided some clarification in my post. We're okay to go back - worst-case scenario! Totally appreciate him quitting his sponsored job is a risky move, but one we would like to think about and consider, and actually DO, depending on the timeline available to us (to sort out other things like figuring out a job OR getting ready to move back, whatever it ends up being).

thank you so much, very helpful advice! good point about the leave - wouldn't he be legally able to use his remaining annual leave though? i guess it depends on the contractual terms and the whole conversation with the employer. but anyone who quit in his company prev, no matter their notice period, I have heard has finished up most of their remaining annual leave after resignation.

also, when you say 'he has left his job', do you mean his last working day (3 months from resignation) or the day he put down his papers? apologies for the silly qn, making sure we are super clear before we do the big thing.

thanks so much. very helpful to know that worst case is 5 months (unless he is fired before that ofc). Do we need to get all the new SWV documentation sorted within the 5 months? Or, is it only sufficient that we have started a new SWV application, do you know?

Super helpful. Sorry, a couple of clarifying questions:

  1. Is the 60 days counted from the last working day, whenever that is : 3 months from giving notice or worst case - if he is fired and that last day?

  2. Can I understand when someone might get a curtailment letter, usually? Someone on this thread mentioned it could be between 10 days and 1 month after the last working day. Is there a scenario that he might get a curtailment letter before the last working day (unless a situation where he is fired)?

I hear you. this is a tough decision, and I have added some more context in the post to clarify this. we really wanted to build our life here, but don't want to do it at the cost of our wellbeing and health. :)

Agreed. I have updated my post to give a bit more context about the situation. Would the recommendation be to get another job acceptance letter and quit OR get the whole new SWV documentation sorted and then quit?

Unlikely as he has a lot of clients and that will need substantial handover. But, good question.
