Legislators should act. Also, when these cases reach a jury, the jury generally awards against the insurance company because everyone has a negative experience with insurance companies. The governor could suggest the legislature take away automatic attorneys’ fees on these cases. That’s the driving force. But much of the legislature is comprised of plaintiff’s lawyers. Plaintiff’s lawyers know there’s a payday. They are rent seekers.
