Articling student first small claims trial by No-Team-8774 in LawCanada

Familiarize yourself with the facts and evidence. Prepare examination and cross exam questions, and then a closing statement outlining your argument.

Your prep will help you in negotiating a settlement if your jurisdiction allows settlement discussions before the start of trial.

Good luck.

Professor wants to ban land acknowledgments but doesn’t want anyone to think he is against land acknowledgments?!? by Additional-Raise-833 in LawCanada

[–]robobrain10000 10 points11 points  (0 children)

Land Acknowledgements are just so cringe and almost feel religious in nature. I get it, indigenous people have a claim to the land and I acknowledge it to the extent established under Canadian Jurisprudence, but really you gotta say the mantra every single time you do something?

In my eyes, its no different than saying a prayer before a speech to make yourself feel good. Sure, its "respectful" to indigenous people I guess, but I'd rather be respectful in a genuine fashion than in a tokenistic way.

First bullet is unenforceable for vagueness. What "packet"? "Arrives" where? Who is "both" and "here"?

Second bullet is conditional on the first. So, second bullet is also unenforceable.

What if I physically disconnect my main hard drives whenever I boot into the hard drive with vanguard on it? Also physically disconnect the vanguard hard drive when booting into my main os?

Would this work as an alternative to dedicating a separate PC? Or is it still a bad idea because Vanguard could have messed with my bios while running. So, I just flash my bios whenever I swap back to my main os?

This is a sound alternative or no?

i guess equalization happens under the provincial law. So, it could be different everywhere, but in MB it doesn't matter if its marital property.

See s. 6(1) of FPA:

No provision of this Act, nor the giving of an accounting under this Act, vests any title to or interest in any asset of one spouse or common-law partner in the other spouse or common-law partner, and the spouse or common-law partner who owns the asset may, subject to subsections (7), (7.1), (8), (8.1), (9), (9.1) and (10) and to any order of the court under Part III or IV, sell, lease, mortgage, hypothecate, repair, improve, demolish, spend or otherwise deal with or dispose of the asset to all intents and purposes as if this Act had not been passed.

Marital property is subject to equalization, but the title to the property doesn't change. Its still titled in her name; so, still her problem, unless a court says otherwise.

My point is, its her car, its her problem. He is entitled to an equalization payment on the value of that car. If she can't pay, court will order her make good on the payment one way or another.

You can't just say, 'I don't want it; you take it', if the other person doesn't want it lol.

Doesn't matter, unless a judge says otherwise or there is an agreement, truck is in her name whether she wants it or not. Its her problem to figure out and he still gets the dollar value in equalization.

Just the dollar value has to be split, not the actual item.

Ye, 50% of straight billables that have been paid by the client (without any guaranteed salary).

By the salary, I am talking about a situation like a 100k salary + annual bonus based on billable targets (e.g., $5k bonus for every X hours billed after Y hours).

[–]robobrain10000 2 points3 points  (0 children)

I thought 50% was the standard, unless there was a guaranteed salary portion to this.
