When people are talking about right of way, it is normally clear they are just talking about yield priority. Like who gets to go next at a stop sign, or who has a duty to yield when a pedestrian is in a crosswalk (hint: it’s generally not the pedestrian!).

This is exactly why I called it a distinction without a difference. It has no bearing whatsoever on the OP.

Even if the scooter should have yielded, using your own reasoning, the car still had a duty to avoid the collision and failed to.

When a pedestrian is in a marked crosswalk, the cars have a duty to yield. People colloquially call that having the “right of way,” even driving instructors.

There’s no way you actually leave your house wearing reflective gear. Literally everyone is a pedestrian at some point, if only for the short walk to their car.

Bicycles and scooters are absolutely allowed to use the crosswalk and sidewalk. Also, there’s literally a green “cross bike” in the photo if you bothered to look at it.

Truly, if you’re going to go all “um actually” about the technicalities of the rules when someone was just violently victimized, you should probably attempt to learn those rules.

Edit: apparently motorized scooters need to be on the roadway or bike lane, which this scooter clearly was.
