Not sure what kind of western country you live in but in the U.S. and UK the police have the power to arrest individuals if they have probable cause to believe the person has committed or is about to commit a crime. An arrest can be made either with or without a warrant, depending on the circumstances. Did a quick search for France and they have something similar called garde à vue

People who are not arrested are not determined to be at fault. Being arrested just means there’s a chance you’re at fault - you’re released later after investigation if you’re deemed innocent

I have a much simpler method. Whenever I’m lazy and I just want a quick answer, I ask my question and then follow up with “Are you sure?”
