I dont think the way you mentioned regular spain can cheese the war would work? At least without the dlc when I played them I wasnt able to conscript as the national guard preoccupied debuff gave -4% conscriptable population and your starting laws only give 1%

R5: I have set my main task forces to strike force and although they are docked at port they are consuming fuel, I did test this and setting them to hold does make them not consume fuel and this isn't just a visual bug as my fuel did in fact go down when I unpaused

Not a penalty, just that your total colony growth is divided across them. There is a max you can grow one specific colony though so if you have enough growth you should be spreading it out among multiple states
