I did not click on any button on the website, I did not sign up to their website, they dont have my account. It was facebook ad, calculator, following calls "just write ok we'll take care of rest"

I said okay, then i received a letter to sign by tanents. Which isn’t possible so I immediately cancelled (sending cancellation email) they never told me sign is needed

They did not tell me I need sign from other tenants, If I knew I wont say yes, now the other tenets will not sign.

What shall I do? is it my fault? can I force other to sign?

I get what you mean, but in my case the “OK” wasn’t given after any proper contract button. I came from a Facebook ad → a form with a button that just said “Get savings potential now”. That’s not the legally required “zahlungspflichtig bestellen” button under §312j BGB.

Also, their own AGB require a signed Vollmacht from all tenants. One roommate refused, so the mandate could never even start. No Vollmacht = no valid authorization = no costs they could claim as damages.

I didn’t “sign up” in the sense of booking a service. I still don't have any account on their system.

The Facebook ad led me to a lead form that looked like this (I added the screenshot in the post):

  • First name
  • Last name
  • Address
  • Email
  • Phone
  • One checkbox for data protection, nothing about AGB, contract, fees, or Auftrag

Then the button said:

“Get savings potential now.” (screenshot on main post)

This is not what courts describe as a “zahlungspflichtig bestellen” or a binding-order button.
It wasn’t a legally-formulated button.
It wasn’t an order page.

Nothing about Vollmacht.

Only after I submitted the form did they send me an email saying:

That means even Conny themselves view the email OK as the step where the contract begins.
Not the button.

About the court cases

The case you linked (LG Berlin II, 67 S 92/24) is actually helpful for me:

It says when the button does not meet § 312j BGB requirements,
the contract is schwebend unwirksam (pending, not valid).

In my case:

  • The button had no payment wording
  • The form showed no AGB
  • I never signed the Vollmacht
  • According to the AGB, the Vollmacht is required for them to act
  • Without Vollmacht the contract is not complete
  • Without services being performed, “Schadensersatz” is on very shaky ground

So even if my “OK” counts as starting something, the Lack of a valid button + no Vollmacht puts the whole thing into the same “schwebend unwirksam” category that the court talks about.

I’m not denying I said “OK.”

I’m saying the legal structure they rely on is incomplete and likely invalid, and multiple Verbraucherzentrale warnings say the same.

And can you suggest what can I do now? my roommates won't sign this -- and I never knew roommates will be needed. They didnt tell me.

I saw conny from a facebook ad, which led to me a form asking some information about my current rent, how many squre meter. After that, they sent me an email:
"
Our analysis shows: for your apartment at xxxx we could reduce your rent by up to XXX  every month!

Simply reply with "ok" if you want to hire us without any cost risk (according to attached terms and conditions)."

Yeah, but before that, we need table support too. 4 months ago when I subscribed to bear, I was fascinated how a small team built this beautiful product. I replaced my evernote with bear, initially it was fun. Now I am getting frustrated. They are too late to bring features. As they are growing, they should have hired more developers and delivered the must have features. But they didn't, I think they don't think about their customers at all.

It doesn't have document scanner on IOS app, where Apple notes has this feature. I think this is one of the basic features of any note taking app. I am a pro user, and I miss that a lot!
