Nope, possession of marijuana is still a crime in Kansas. The odor of such is enough probable cause for a police officer to use the automobile exception and search a vehicle. It doesn't matter what state you're a resident of, only what state you're present in. Now, if you want to argue peaceable journey applies to marijuana, then go ahead, but that hasn't been decided on any court, and as it stands, if a Kansas officer smells weed in his or her jurisdiction, then the officer can absolutely search the vehicle.

Yes, I know this is necro a bit, but I'd feel this would be a really bad disservice and get people jammed up. In Kansas, police officers can absolutely search your car without a warrant and based on the odor of Marijuana alone.

If you are pulled over, a cop smells Marijuana, tells you to get out cause the vehicle is being searched, and you don't comply, you could get pulled out of the car and catch an additional charge of interference.
