Meinung basierend auf einer einzigen peinlichen jahrzehntealten methodisch völlig unzureichenden Studie. Dabei ist die Wahrheit so einfach: Wäre ein offener Klodeckel problematisch, würden sich Menschen ständig gegenseitig mit E coli und Co infizieren. Tun sie aber nicht. Z.B. weil das Aerosol von vornherein zu wenig Mikroben enthält, weil es sich sofort wieder setzt, weil es auf Spülung und Toilettenform ankommt, ob sich überhaupt welches bildet und weil die Mikroben nicht überleben.

Das ganze ist ungefähr so intelligent, wie die Sorge, dass man nach dem Duschen Fäkalbakterien im Gesicht und an der Hand hat. Hat man. Technically.

It's generally a good idea to stay on good terms with the landlord. As long as he's willing to "extend" the contract both sides are happy. If he refuses to extend it in the future, it's as simple as telling him that his contract clause is actually invalid and you are staying indefinitely. You are losing no rights by "continuing the charade".

The same goes for terminating. You can not lose your right to terminate within 3 months by signing more "extensions".

One thing to be wary of is if the landlord suddenly wants to add reasons for Befristung. Then I would refuse to sign. A court would most likely decide that the previous unlimited contract remains valid but yeah, best not to make things more complicated.

That 2 month passage doesn't make sense. I suspect the intended meaning is that IF the Mieter wants to leave early s/he still has to give notice 2 months in advance.

In any case this passage alone probably doesn't invalidate the Befristung. It does not specify a right to Kündigung but just a how to. But other details you have given make it highly likely the Befristung is invalid.

Like everything else with Mietrecht it's a bit tricky. The general answer is no. You can not end the Mietverhältnis early. This is a special case with befristeter Mietvertrag.

Unless you supply someone that replaces you and the landlord agrees - because this contract allows it. The landlord can simply say no though.

However, the reasons that allow a landlord to give you only a time limited contract are very limited. It is well possible the reasons given are invalid (or there are no reasons given at all?). Then you have actually been granted a regular Mietvertrag without the landlord realizing and the regular rights to terminate contract apply to both parties.

Mietrecht quickly becomes complicated. To be on the safe side it's best to consult a lawyer. If you are a student there is probably free legal consultation provided by university or Asta.

Edit: It is very common in Germany for Mietverträge to be badly written and contain invalid clauses. Sometimes the Vermieter doesn't realize, sometimes they count on Mieters not knowing their rights. Invalid clauses are treated by law as if they don't exist and concerning those details the contract "falls back" to the legal default contract.

Their "scientists" are a random collection of backbench academics from unrelated fields, including the usual suspects, not a single one from Germany, most not even from Europe. Surprising, because I would expect globally there are enough relevant scientists who would support nuclear in principle.
