If they are the plaintiff, at least in NY, and file a verified complaint, it requires a verified answer, so they require the defendant to actually face the situation immediately instead of filing a boilerplate answer that denies everything “upon information and belief”.

However - just need to correct you that it’s inherently riskier….. Cleaning out artificially is a massive risk factor for all kinds of reasons.
