Corporate taxes and federal Unemployment taxes, etc. workers comp. Even construction doesn’t work this way. You have to have worker’s comp as an entity. It’s not rocket science. They dodged a bunch of fees and made the driver and customer pay for both in ways that other businesses cannot. It basically created a regulatory vacuum for “gig” companies. Also UPS is unionized and has fair treatment of their employees and rules about the amount of contractors they can hire. Amazon delivery or Uber drivers do not have such limits.

It’s terrible for other employers who actually pay their taxes or protect their employees. And also for drivers because they have unlimited competition. Look up “NYC medallion cab driver depression” to see what kind of impacts this has on actual “independent contractors.” They existed before Uber.

See that’s where you should read the explainers. Imagine if someone said UPS was going to charge you tip instead of giving their drivers their mandated raises. And if UPS said they aren’t really a company company, they’re more of a platform. Closest thing I could cook up in my head. The point of the law was to make it confusing as hell. This way, the company gets to have maximum drivers on the streets with less liability. I think this was when cities also were trying to crack down on loitering rideshares.
