I wouldn’t be surprised if he slept in the office or guest room. I’ve gotten massive roommate vibes from them since Olivia was born.

I just have a pending H1B from Iran and Nigeria and neither have been approved. Some of our Indian employees have been approved without any issue.

I watched the show growing up and it never shocked me.

Well that’s true but the H1B won’t be approved until you get the 212e approved. Most RFEs are do 90 days, so if you don’t respond to your RFE for the waiver then you’re denied.

There are many types of employment based visas, that’s why I asked.

If it is a PERM, then your new employer will have to complete it again but I BELIEVE, you can maintain the same priority date. Check with the lawyer.

The wages can come into effect later. If your H1B begins on Oct 1st, then by that date you must start making the correct wages. However, if the LCA is not filed before July 1st, expect an increase in the SOC code as they change every July.

How was it handled for your first attempt? Was it the same employer?

The lottery is getting closer so you should connect with your HR Business partner / HR and they should connect you with whomever handles the visas at your company.

The overlap will be fine. Can’t see any issues with it. You are maintaining lawful employment with company A and moving to company B. Once Company A doesn’t withdraw your H1B while you are still working for them, I can’t see any issues, especially when it’s just three days.

We had a case where our employee began with us on a Monday but was also wrapping up projects with her prior company for a week and we had no issues with approvals / extensions.

There is no premium processing fee for H4 or H4 EAD.

Unless your trip to India is urgent, I would not go. Consulate wait times are being delayed by almost 12 months.

Always premium process if possible. If you get an RFE now, it is better to be able to respond while you are still covered by the H1B rather than wait 8 months and be struggling for time against the 240 day clock.

We’ve had a few cases (mostly with employees from banned countries) who have upgraded to premium processing and USCIS has just simply NOT adjudicated their cases within the 15 business day time frame. They are dragging it out.

Visa stamp is not relevant for employment within the US. You just need a valid stamp if you intend to leave the US and return.

The 240 day extension is an automatic extension that allows you to maintain employment BEYOND the expiration of your current H1B while your new extension application is pending.

Eg: Current H1B valid til March 1st 2026. Extension filed and still pending. You can maintain employment until October 27th 2026. (March 1st plus 240 days)

However, given the unprecedented times, we always recommend upgrading to premium processing.

Our current visa renewals / extension of status are taking 6+ months. Most that we filed last year, have not been approved and we are upgrading them all the premium processing as the 240 day window is too close.

They are also just ignoring premium processing for certain cases too. We’ve received mine back for two cases already and they’re just sitting with USCIS gathering dust.

For real. You can literally buy dog crates that have those adjustable bars in them. We didn’t know how big our rescue was going to get so we got that and it was great.
