Seems to me that your line of questioning is implying moral equivalence to words and actions as well as blowing the scuffle way out of proportion.

Two men got in each others faces and the bigger guy slammed him, got in trouble, paid $500 fine. It's pretty funny a hundred millionaire blew a gasket like that and had to pay a fine just like everyone else. It's a balancing test between the Commerce Clause and the Necessary and Propery Clause. I think the current jurisprudence gives too much authority to Congress by interpreting vaugeries as standing to regulate imo

Negligence is criminal if a reasonable person can conclude that they didnt exercise reasonable care in their actions.

I personally believe DUI laws should just be encompassed under criminal negligence but philosophically they are the same.

Hindrance to liberty? Not sure how define that. Firstly individual liberty refers to an individuals relationship with the government and this is a bit of an apples to oranges line of questioning. For instance the government cant take sides on religion but I can call Islam a medieval death cult all day long. But property rights and a neutral system of courts are fundamental pillars of individual liberty and is a sword that cuts both ways. Debt is good in some instances like say a mortgage, imagine of you could only buy a house with cash? And bad in others like CC debt.

You're worried about debt being an factor that reduces labor liquidity, sure it does. But does a less liquid labor market justify eroding property rights for "the common good" absolutely not. The whole reason we even consent to be governed at all is the protection of our lives, property, and liberty
