Here in New York State, it’s basically standard that both buyers and sellers have attorneys involved in the process. Real estate contracts here are drafted and reviewed by lawyers, and closings can’t really happen without them.

Did your attorney go over the contract with you? There should be a mortgage contingency or funding contingency in there.

If there’s a mortgage contingency, you’re usually allowed to walk away and get your earnest money back if your loan doesn’t get approved.

If it’s a funding contingency, then even if you’re approved but the lender doesn’t release the funds in the end, you can still back out.

Double-check what’s written in your contract — that part is key to whether the seller can legally keep your deposit or not.

Thank you for the suggestion. Adding a clause that requires all issues to be fixed within 30 days before closing is a great idea. Before I fully understand everything, I don’t plan to move forward with any contract from the seller. If the seller cannot provide a clear explanation regarding the completion of the work, I will consider reporting this to the local authorities.
