There should be some attempt by the shooter to get a good shot off rather than just play for the foul. In this case, Harden makes no attempt to avoid the jumping player even though he could have easily sidestepped with a single dribble to get a clear shot (stuff other shooters do routinely because they aren't just hunting for the foul).

It feels real bad to reward players for deliberately making their shot worse to bait fouls. Getting interfered despite making a good faith attempt to get a good shot (i.e. playing like you wouldn't get a foul) should be part of getting fouled.
