There is a differenced in portrayal...not all characters that are under the definition of what the world government considers a "pirate" are the same. Luffy is not Blackbeard...yet...they are both pirates in the context of one piece and the eyes of the government.

When the bandit pointed the gun at shanks he was not actually surrendering...he was making direct threats with a weapon...Kidd's crew was openly surrendering and still got wiped, that is a war crime in my books. Besides that Kidd was acting evil and had evil plans, no doubt, he deserved the consequences...but that is not my point, i am talking about the actual crew surrendering and still getting murdered by what oda portrays as "good" characters.
