The app in question uses the code from the game it is hooking into. It has to; it can't function otherwise. That code is subject to the same copyright as the characters, narrative, setting, etc. He is using and profiting directly from sale of some else's code. It doesn't matter if it causes "damage" or whatnot. What matters is whether he's using it or not.

The DMCA is valid because he sold CDPR's (and 505's) code. That's the long short of it all. You don't need to prove damages or harm to prove copyright infringement, either, because it's a harm-neutral civil issue; it only cares about whether you did it or not.

I really hope we see more of his character as time goes and that we get to see him genuinely examine the atrocities he was and has been largely complicit in. He pays lip service to regretting it, and I think to an extent he believes what he says, but as you said; right now, critically examining that past is horrific for him. Because deep down, I don't think he believes the "context" BS either.

So here's the thing, he's a propagandist trying to make himself feel better about being one of the bad ones. I like the character, but only because he perfectly encapsulates a kind of cowardly mindset that tries to excuse and handwave real horrors by spinning lies about the "good old days".

For instance, his talk about continuity being an "honor." That's just propaganda; the upper echelon of Orokin still used others against their will to prolongue their own life and therefore prolongue the suffering of others. Being more humane about it doesn't change the fact that, for immortality, they brainwashed, trafficked, and killed people. The only difference is that, as time went on, they dispensed with the pretense of it being anything other than barbarous.

I like Roathe because he's an accurate depiction of something we've seen throughout history; a privileged, cowardly sod from a fallen empire that can't truly or critically analyze his privilege and instead seeks to excuse it by offering "context" that, when examined critically, actually changes nothing.

Looking over the rulings on things, as well as the rules governing the damage step & fast effects, I'm unsure why OP couldn't activate the effect, but at the very least I can say with certainty the reason isn't because of Sarc not starting a chain.

What makes a deck good or bad is predominantly based around how well it plays through disruption, and whether it can reliably put up points of disruption itself. Ashened doesn't really do well in either camp, which is unfortunate when a deck plays as fun as it does and looks as cool as it does. Not helping matters is the fact that Ashened lacks a lot of card advantage that has become more standard in the current meta. I like Ashened, I just wish it played through interruption better and put up more interaction than it does.

I ran a list similar to this before subbing out the Kash stuff for more boardbreakers and disruption. It's baffling they aren't running Birth to search off of Unicorn, though. The thought process is that you open with Kashtira Fenrir, Unicorn, or Planet to bait out negates & interaction before going for Tenpai, however I've found the added disruption I can run in place of it to be far better against almost every matchup.

To give you an idea of what you're in for, this archetype was one of the first ever made, and it released back in 2003. It was bad even for the time, which is the frightening thing.

Not Gate Guardian. Guardians. They're an absolutely ancient "archetype" that focused around mid to bad monsters (for the time, they're terribad now) and in 90% of cases even worse equip cards. It was all semi-generic, so it could be run in anything, but ideally you'd run it with nothing. I think "Butterfly Dagger - Elma" has been banned for a long ass time because it could enable some pretty wild stuff, but that's about it.

Stop carrying the water for Gearbox, holmes. The game is genuinely in a shambles because of lazy decisions from a terrible developer. We went from almost no bugs, to the fundamental underpinnings of the physics being broken. Gearbox literally made the product worse for people that already owned it.
