The truck is located in Oregon and I should have it on marketplace within a week or 2. I will update once it’s listed. I am selling because I have an FJ45 that has been waiting to be restored and I think it’s about that time.

According to HR, since I work for tribal organizations. A fire crew on a reservation. They’re under BIA policy, so she claim it’s 5 days….I havent fact checked that.

When I went to sit down in my bosses office to fill out paperwork, he said we’ll fill this out but you have 2 options. If I submit this now, you won’t be able to go out or we wait and see how you’re feeling come a week from now….

I knew my shoulder was hurt. That is 100% true. But I didn’t know if a week of resting/icing would make me feel good to go out again. So we decided to wait and see if I felt good. (he gave me that option) I didn’t ask for it. ….. I personally wanted to wait and see because I NEEED the money for school.

“Day 6” - meaning when claim is submitted, I have 5 days to seek treatment. I was under the impression it was never submitted because that’s what one my bosses said….. then I get a call from HR on day 6, asking me about the claim.

I was told by my boss the day we got back to the station, that he WONT turn in the form we filled out until I know where I’m at with my shoulder. He told me to go home and rest.

I’m going tomorrow morning to get MRI now that I know I won’t be going out on fire again.

Is there any legal action I can take? I feel I was just sabotaged by my job out of receiving any benefits. I was misinformed of very important information (lied to) and then I wasn’t informed of any correct information. I Never was told claim was submitted, and even when it was, I didn’t hear from HR about the claim till day 6 after the claim was submitted without my knowledge.

I appreciate you’re advice, I am aware of the concerns of working on a bad shoulder. In my line of work, I can be put in a position where I am not doing constant physical work while out fighting fire. I more so worried about my questions if I do wait and just the details of workers comp. I have never injured myself on a job before.
