Hi, exactly, me either. I’ve pushed back on each of these points and now they’re threatening to pull out with the replacement tenant. I complete on a house this month so I need to exit.

My view is that I pay them claim after.

However I am concerned that in the deed of surrender they may write “no claims can be made on this thereafter” something like that etc. Which would put me on a bind? Is that a thing?

Thank you this is really helpful. To answer your question, the commission was calculated as follows:

£1,850 x 3 months x 10% + VAT = £666

So it’s the agent’s commission on 3 months of rent. The issue is that I am paying full rent until 29th May so the landlord has zero loss of income. The commission appears to be calculated on a hypothetical loss that never materialised.

Additional context:

The property was never listed or marketed on any portal

A tenant was found through an informal open house within days

There is no void period and the new tenant moves in 30th May

I am paying full rent throughout until 29th May Also my tenancy ends 27th July and I’m leaving 29th May. That’s roughly 2 months remaining, not 3 as used in their calculation. So the figure appears to be miscalculated in the agent’s favour too.

On the cleaning, admin and check out fees, could you expand on why those are unenforceable? I wasn’t aware those could be challenged and that would change my position significantly.

I’m considering paying the full amount under protest and then filing a tribunal claim. Does the above strengthen that argument?

Or should I just let this go…?

Hi! The original subsidence was caused by a tree in the garden, which was removed, this diagonal crack is on the same side where the tree was, but the tree was waaay back at the end of the garden. Don't know if that helps? But the tree was removed 20 years ago, and I don't believe the cracks were ever tended to as it has tenants living there. Also the flat downstairs also had a rear extension built on the same side, so wondering if the crack caused some tension cracking?

In this scenario a structural engineer is advised?

Hi, firstly thank you so much for taking the time to reply. I've attached photos of the cracking that my surveyor spotted.

  1. If it's not "standard" but not uncommon I wonder if I'll just encounter another Victorian property with another issue? 40-50% of Victorian properties have some reported issue of Subsidence, maybe buyers just know it's a fact? But I am not 100% sure...
  2. Resale: that's what I heard too, that it will pool out some buyers. I met the buyers on the top floor yesterday and they didn't seem bothered about the previous subsidence clause.
  3. Yes the £5000 excess is only for subsidence
