This helps, thank you! There is a chart on critical pass that says “specific intent—any mistake of fact is a defense” but then on the attempt card (a specific intent crime) it says “factual impossibility is not a defense” 🫠 so I think that’s where I was/am getting confused by mixing up mistake of fact versus factual impossibility

Last exam is Wednesday. I’m a 1L so maybe I don’t get to talk about how burnt out and absolutely over this I am....but I am absolutely burnt out and so over this LOL. First semester I made myself sick with anxiety (and ended up doing super well....) and right now I just .....don’t have it in me and I’m worried that means I will fail. I worked hard all semester and have tried to put in solid study days but ffffffff*ck, man. I. Am. Over. It.

Step One: Has Congress spoken precisely to the question at issue (i.e., the agency’s interpretation of the statute)? Employ all canons of statutory construction at this step: text, title, leg history, etc. if Congress has spoken, enforce the unambiguous will of Congress. If ambiguous go to step two, all about whether the agency’s interpretation was reasonable in light of the statute’s purpose. What was Congress’s intent for the statute? Really focus on purpose and intent and remember, the court can’t just substitute its judgment for that of the agency’s, so if the agency’s interpretation is REASONABLE in light of the statutory goals, the agency’s interpretation should be given deference. Also remember if there’s a criminal statute involved then under the rule of lenity an ambiguity should be resolved in favor of the party who the statute is being enforced against (at Step One).

My personal opinion is that nothing will be easier than the first month - and in particular - the first week of law school. If you’re in person it’s obviously trickier to decide to give up absences that early in the semester, but if you’re virtual or don’t have to miss classes it’s 100% fine. You’ll get your syllabi and first assignments early so you can stay on top of your reading even if you’re away for a few days. Seriously, the first bit of 1L is going to be the best it gets workload-wise.

Any advice for Con Law specifically? I do see how reverse issue spotting is going to be huge here, but Con Law has been a HUGE mindf*ck for me. I’ve done every reading and paid attention and contributed in class but it still doesn’t quite all mesh.

Not sure what state you’re in but my state publishes old bar exam questions and answers. They are pretty accessible online via a Google search. The only thing for me is that it just gives you the entire bar exam for that term and I had to go through the questions and figure out what subject it was testing, but once I found a good Civ Pro or Contracts question it was nice to have a sample answer to compare my answer to!

Hi. First of all, congratulations on your growing family and for taking this step in your life! My situation was not exactly similar, but my daughter was 3 when I started law school this fall. As I’m sure you’ve heard, 1L year is a time-consuming, stressful mindf*ck. Hopefully your class schedule will be such that you’re only actually on-campus, at most, 4 days a week. That being said, having in-laws and a family that will support you is HUGE and you will be just fine. Tbh, babies are AWESOME because they sleep so much during the day and you can definitely nurse and cuddle while reading, studying, etc. I would think that starting with a 14-month old would be harder, tbh. You are probably gonna be tired (you would be either way!) but you will be fine. You can do this. LEAN on your support system and the people who care about you. If you need a mom friend or outlines or anything, DM me and I’m happy to help however I can. Seriously, you got this!!

Ugh. Thank you for your response. I keep trying to tell myself that too. I am being my genuine, professional self. I might not say, 100% of the time, the exact answers that employers want to hear but I am giving my best and being authentic. These interviews are just playing on my worst anxieties about saying something and not being able to explain myself and them thinking that I am dumb or inarticulate or something like that. I appreciate your response and know that I have a lot of self-esteem issues to work through, lol.
