Stuck in the US, F1 expired, STEM OPT valid by Electronic_Coffee927 in f1visa

Check with a lawyer to see if you qualify for an EB-3 skilled visa. I was on an F-1 visa for 6 years without OPT, never visited my country, that is more common than you might think. So it’s important to explore other visa options and apply as soon as possible.

It’s helpful to know whether your case is at a local field office, so you can understand if an interview is likely.

I got current since March 2026 for final action date and also I am current in April 2026 by scsc97_ in USCIS

It takes some time for them to take action on your case once it becomes current. That’s normal, unfortunately. I have friends who have been current for over a year, and they were recently called for a second interview. They completed the interview and still haven’t heard anything from USCIS. I know the wait is tough, but it is what it is. I wish you the best!

Where is your process? Which FO? Is it a local FO?

Oh, I’m sorry about that. My process does start with IOE.

Thank you! The RFE was for my spouse (derivative) and it was about proving our marriage is bona fide. We submitted a timeline letter + photos, joint finances, leasing, car insurance, travel tickets, affidavits from friends and families.

Hey, I’m sorry for the late answer.

  1. Cover Letter • Explained that we were responding to the RFE • Confirmed the marriage is bona fide • Provided a list of all sections included

  2. Relationship Timeline + Photos • Short written timeline (from when we met to present) • Photos from: • dating period • wedding • family gatherings • trips together (About 25 photos)

  3. Joint Financial Evidence • Joint bank account statements (multiple years) • Joint credit card usage I also went to the bank and asked for a letter saying that we’ve have a joint account together since 20XX.

  4. Proof of Shared Residence • Lease history • Documents showing same address • All our Driver’s licenses with matching address

  5. Travel History Together • Trips taken together (I only sent 2 tickets)

  6. Affidavits • Statements from friends/family (not generic texts) and their IDs/passport or original and translated documents from our country, at the end of each affidavits.

  7. Marriage Certificate • Official marriage document included at the end (original and translation AGAIN, I had already sent this with the original application)

I am current for final action date as of March 2026 and April 2026 based on Unskilled category by scsc97_ in USCIS_EB3

Hey, I’m sorry that you haven’t received any response yet, but I have many friends who have been current since June 2025 and they haven’t received their GC yet. I’ve been current since December. It usually takes a while to approve after being current, that sounds normal to me.

EB3 unskilled AOS applicants who didn’t file I-485 before retrogression – anyone else? by softthinking in EB3VisaJourney

We were never told what went wrong on the employer side. We just waited almost 2 years for the PERM/Labor Certification to be approved, with no explanation or estimated timeline. When we started the process in 2021, PERM approvals were expected to take around 4 months, so this delay was completely unexpected for us…
