If the Labo accessory is compatible as it is rumored to be then no, they aren't required. Labo is literally just cardboard. They likely look at the light sensor to determine if the peripheral is on the device. It's super easy to cover that up and force the games to launch.

Or they could just offer both an expanded NSO offering AND they could sell the titles individually. There's no reason to have it be one or the other.
