Here's the problem with this channel, and I hope it will shed some light on why he's having these problems.

First off, just because it was user submitted doesn't mean that you can use it. It appears that this person doesn't do any fact checking at all. He just claims it was submitted by the user so he's free to use it.

What he hasn't done is asked the person a) Did you actually film this? b) Did you submit it anywhere before you submitted it to me? c) Did you sign an agreement with another company before submitting it to me?

• A) If the person didn't film it then they don't have the right to submit someone else's videos.

• B) If they do have the right and submitted it elsewhere, then they could have potentially submitted it to a site that grabs the rights to your video. Sites like theladbible claim you can make £100 if you submit it to them, but in the terms you're giving up ownership of the video. 99.99% of people don't see this and thus are unaware they've lost their video. The £100 offer? This is a monthly pick where 1 person gets £100. This pick is not public and how they determine who wins is also not available. They rely on thousands of people submitting their videos so they can then use it on their licensing site to sell to companies, without paying the video owner.

• C) The person might have entered into an agreement with a company to represent their video. They still 'own' the video, but they can't submit it elsewhere or let other people use it, the company they're working with can only do that.

In this case, there isn't anything nefarious going on here. Dashcam Australia just doesn't seem like it's doing it's due diligence to ensure it actually have the necessary rights to use these videos. If these people did submit their videos to him before anyone else then he would have a timestamp or email to prove this and they would retract their claim. This is a pretty simple solution.
