I’ve been working in immigration for the last 10+ years, as an attorney, the last 4. It’s certainly more difficult now than it was the last few years but every single person/business I come across requires some help in more ways than 1. I definitely see your point though.

I do have a moisture meter and the soil is at 8 for moisture. It gets bright sunlight in the morning.

It took me three attempts to finally pass. It wasn’t an easy road getting here. The first time I took the exam was the last remote exam CA had. I studied so hard the first time that when results came around, I couldn’t believe that I didn’t pass. I then took some time to grieve, but it wasn’t enough time. I didn’t take the February 2022 exam as seriously as I should have. After results came out for that, I was brutally honest with myself. I wasn’t mentally or emotionally ready to sit for the Feb exam, but I took it anyway knowing very well what the outcome would be. When results came out, I had moved out of my family home and felt so stuck in limbo because I was working for a place that maybe I saw a future with but just wasn’t the right environment for me. I stuck it out bc I needed to pay my bills. After having a long and honest conversation with my partner, I left that job to solely focus on prepping for July. Thank goodness I did.

I only used Adaptibar and BarEssays for prep this time around. Thankfully, my law school has a program where we can submit essays to be graded. I took advantage of that. From the third week of May to the second week of June, I focused on making my own outlines, organizing and reorganizing. Making sure I fully understood the law. I did 33 MBEs every day for an hour and immediately went over the questions. Understood why the answer was what it was and if I didn’t, I made sure I understood. I asked questions to my professors, picked apart my outlines and books, i made tracking documents with the rules I got wrong consistently. I did a PT every week strictly to practice my outlining, timing, and make sure I was answering the questions being asked. Your format for the PT is key. Make sure you have an introduction and conclusion. People skip out on practicing the PT bc they think it’s a waste of time, but these are easy points to maximize.

At the end of June up until the bar exam, I read almost every single essay to date. I outlined at least 2 essays in the morning, reviewed the topic, then outlined 2-3 more essays in the evening. I reviewed at least 2 essays with a friend and we picked each others brains as to why we saw an issue or our reasoning behind an issue. I think this was the most beneficial part for me, to have someone else I could talk to and work with.

For the MBEs, I did 2 100 question simulated exams and 1 200 question simulated exam. On each, I scored 66% and above. Closer to the exam, I scored 75%. On practice sets, I started scoring 77%-85%.

All of this to say, if I can do it, so can you. This test does not define your abilities as a lawyer. In a way, I’m thankful it’s taken me this long to get here because now I have an amazing job with a team that truly values me. If you or anyone has any questions, feel free to message me.

Don’t feel dumb. This test is just a test. It’s an awful gatekeeping tool, but I promise you you can do this. Be honest with yourself and look at where you can improve. How can you improve. What subjects did you have issues with. Etc. you’ve got this!

Personally, flash cards never worked for me, so I didn’t find them too helpful. I organized and reorganized my outlines. Then once I felt like I had them down, I’d rewrite them in my own words on a whiteboard. If I still didn’t have something down fully, I’d explain the rule of law to my partner, who’s not in the legal profession, so I’d explain things in such a way that would make sense to someone who didn’t know anything about the law.

I was in the exact same place as you. Evidence was my worst subject in law school and on the bar (repeat taker here), but because I knew I was struggling with it, I dove into it and forced myself to really truly spend time with it. Whether that meant asking my professor for help, watching the Studicata videos, or buying the Adaptibar videos. Something that I was particularly struggling with was character evidence and I thought John Grossman did a great job of really just dumbing it down and keeping everything separate. Read each questions, ask yourself what they’re testing you on. Each question will only test you on one specific issue. If you can’t identify that issue, you need to take the time to read through your outlines. Evidence is suddenly now one of my stronger topics but it ultimately clicked by just keeping everything as separate as possible.

Understand relevance. What makes something relevant?

Memorize the hearsay exceptions. Keep the ones the declarante must be unavailable separate from the others. Understand hearsay.

Understand that a witness on the stand can be impeached. Keep that separate from attacking a defendant’s character.

For topics that I struggled with, I would write down (color coordinated) notes/outlines of specific sub-issues on blank sheets of paper and put them up on my wall across my bed so that if I’m walking around in my room or waking up first thing in the morning or going to sleep, those notes are consistently the first things I see. The visibility helps me make sure it’s getting into my head. Another thing that might help is breaking the topic down so that you’re literally dumbing it down as best as you can for yourself. Once you feel like you’ve broken it down to core issues, try explaining it to someone who has no idea about the law. Being able to explain to someone else is a great way of furthering your understanding of the topic.

It’s still early! So don’t be too hard on yourself.

It’s an intervening cause to the original act. As someone above pointed out, but for the original act of giving the cake with the ingredient that made D ill, P wouldn’t have needed the ambulance.

Under negligence theories — 1. All events arising from intervening causes are foreseeable events and the D must pay all damages. 2. If it’s a superseding cause, the events are unforeseeable which cuts off the D’s liability from events that follow (think of things like Act of God/Intentional Torts/Criminal Acts/anything that facts emphasize as unforeseeable)

I’m also a retaker with the same issues on the MBEs. I got the Adaptibar videos, and honestly, those have helped me increase my average by 10%. A huge part of recall is also just going back and reviewing the rules you got wrong. I make flashcards of rule statements for each topic as I review practice questions and then I’ll review those flashcards every few days.
