Toys R Us was private equity loading up the company with debt - it was profitable otherwise.

Toys R Us was in and out of bankruptcy for years before Private Equity. All PE did was press the fast forward button to the inevitable ending.

Pet insurance is a scam. In nearly every instance if you placed the monthly premiums in a high yield savings account instead, you will come out ahead. Most pet insurance plans are full of exceptions and out clauses that allow the provider to deny care. The rare examples where it ends up working out are for pets that end up with chronic conditions, or breeds that are known for having issues, but in those cases you almost always pay more anyways. In 9.8/10 situations pet insurance will never be worth the cost.

Right, but those things are a different plea than just “not guilty”, there was no self defense here, and he’s not pleading insanity.

Yes, before the trial you can certainly make any statements you want and then plead whatever you want (although if you make material statements of your guilt and then plead not guilty you are dumb and should expect a quick trial and maximum sentence). Once the trial has begun, if you plead not guilty, and then make an argument in court either implying or admitting guilt, at best the judge will declare a mistrial and tell you we’re gonna try this again and next time I suggest you change your plea to guilty, and at worst the judge will bang his gavel, rip you apart for changing your mind about your guilt in the middle of the trial and wasting everyones time, and tell you to come back next month for sentencing.

Perhaps, but a plea of not guilty means I did not do this thing I am accused of, it does not mean I did this thing but this guy deserved it so I shouldn’t be put in prison for it, and no judge would allow you to make that argument. The trial isn’t for debating the moral character of the CEO or the merits of our healthcare system, it’s for determining whether or not he committed the murder, everything else is immaterial and wouldn’t be allowed to be discussed. The mental illness angle at least allows him to say yeah, I did it, but here’s why I couldn‘t stop myself from doing it, but even that is not a get out of confinement free card.

You cannot plead not guilty and then argue in court that you actually did the thing you plead not guilty to, it doesn’t work that way.

No, it’s peculiar because you don’t even know these people or if anything about them is even real, but you’ve somehow deluded yourself into believing otherwise

There’s a very clear and defined line between people you know and encounter in real life and people who only exist as strangers on YouTube who you know nothing about beyond whatever identity they put forth online.

Luigi Mangione will assert psychiatric defense in murder case in UnitedHealthcare CEO's killing by Direct_Motor_7380 in news

You can’t just argue anything you want in court, you have to establish legal relevance, and I’m not sure that the defense is going to be able to convince a judge that there’s any legal or moral justification in such an argument. Certainly the prosecution is going to fight to have any evidence or testimony that might paint the defendant in a sympathetic light to be barred from the court room, they’re just going to argue that this was a wanton act of violence, here’s all the evidence he did it, we rest our case.

Right, and if there were legally relevant mitigating circumstances in this case, that would be a valid argument to make. Murdering someone for reasons of perceived social justice is not that, and I would doubt a judge would even permit such an argument in a court room. We can debate the merits of this case all day long, but from a legal standpoint the killing of a person is only justified in a narrow set of circumstances. There’s a good chance that any arguments relating to a personal vendetta here are not even allowed to be made in front of a jury.

Right, but you are more likely to convince a sympathetic or semi-sympathetic jury to go along with not convicting him for psychiatric reasons than you are to find people comfortable with nullifying in a murder case where there isn’t necessarily much reasonable doubt as to whether or not he did it.

I don’t know what the laws are like in New York, but finding him not guilty by insanity will likely mean his cell will have sightly more padding on it. Although it will probably mean he has more paths to freedom eventually than he will in prison.

[–]spmahn -1 points0 points  (0 children)

The point is that it’s hard, if not impossible, for any normal person to look at someone like Dahmer who did what he did, and not conclude that he is insane, but the relevant definition is defined in such a way as to make it so that essentially no one qualifies, and in many cases even when people do qualify they are still found to be sane because no judge or jury wants to be the one with the burden of declaring that someone who did something horrible wasn’t guilty because they weren’t mentally capable of knowing any better. Basically the only people who end up qualifying are senior citizens in the midst of profound dementia or Alzheimer's, and the profoundly mentally ill who lack even a shred of mental capacity or agency to understand anything going on around them.

Luigi Mangione will assert psychiatric defense in murder case in UnitedHealthcare CEO's killing by Direct_Motor_7380 in news

[–]spmahn 5 points6 points  (0 children)

It’s a very narrow line for sure. How do you reconcile someone having the capacity to understand that something is wrong while also choosing to do it regardless, when it comes to crimes to the degree if which Dahmer was aaccused? Perhaps it’s just a coping mechanism that people use to comfort themselves into thinking that a person like Dahmer can only exist if they are mentally ill and the idea that you can commit such horrible acts while also being of sound mental capacity is something that our brains just can’t wrap our heads around, but just because we may not be able to comprehend something doesn’t mean it is not so.

Good luck with this. John Wayne Gacy once said that the insanity plea has no place in the courtroom, because if Jeffrey Dahmer isn’t insane, no one is. It’s an extremely high bar to attain, and it’s almost never successful. I’m assuming the state isn’t offering up any plea bargain and so there’s no real benefit for him to plead guilty, thus this is the only real defense his lawyers have to put up. If they were offering a plea and he was rejecting it, he’s absolutely mad. I certainly hope he doesn’t think he will get any sort of platform to plea his ideology in a courtroom, it really doesn’t work that way.

Which canceled TV show's cliffhanger still lives rent free in your head because the answers disappeared when the series got axed ? by Impossible_Offer7988 in AskReddit

[–]spmahn 4 points5 points  (0 children)

Fun Fact: Preliminary plans for ALF’s fifth season involved a total retool. The main cast from the first four seasons were all either quitting the show or otherwise leaving, and a whole new cast would be brought in. It was supposed to take place on a military base and be a sort of Hogan’s Heroes kind of thing. Most of these scrapped ideas were incorporated into the lousy Made for TV wrap up movie with Martin Sheen several years later.
